ok.. i found my pic listed on this phone sex site. the pic was taken by a photographer and i am in the porcess of finding out if he sold the pic to the said webmaster....now my beef is with the false information that could possibly have my children taken away from me.

they have my pic with a different name (no probleml), you click on my name and you get a whole little page on my so called life (all false) in in they say i like mommy role play and that my youngest lover is 12..WTF! Now the wierdo mommy little boy shit is enough to make me sick let alone true.....so do i have rights for them not to publish pedophilic statements supposed made by "my picture"?

Generally the photographer has rights to use a picture, as well as the person(s) in the picture.
However what you're describing is in no way legal, unless they're based in some fucked up country that's so screwed on drugs they haven't come around to creating laws yet.

if the contract says they can depict her however they want, then she can't sue. whether or not the text is legal doesn't matter, unless the contract specifies that.

You need to SUE. If not, who knows, you might even get arrested if people actually know its you and believe it. You might have cops knocking on your doors with a search warrant, OR WORSE, have some sicko pedo's knocking on your door. By getting a lawyer and taking action, you are saying that what they did is BULLSHIT and you are seeking DAMAGES.

You should also change your # and do some other things that could be shown in court as you taking appropriate steps to avoid sicko's.... Showing some type of suffering, even if you havent had any sickos try and contact you, you could get some more $$$ if you sue. it says the youngest lover you had was 12 years old. it doesn't say how old you were at the time. you could have been 12 too, or 15 or whatever.

Great, so models are now going to be looking at the sales contracts that their photographers use, to see if it acceptable to them.

I have a provision in my affilaite program that my pictures cannot be used in a "demeaning" mannor, such as "fatty, whore" etc. I havent had a problem yet, because most of my affiliates understand my niche :-) However, thats probably not going to be in my modeling contracts.

Can Content Providers post an applicable sales contract that would prohibit this? Or at least provide damanges in case something goes wrong? I think it was Unseen that had his models on an STD site, that the photos couldnt be altered in any way, something along those lines.

Contracts don't mean shit when the law is broken like this. This is an easy claim against the site operator, their provider and whoever licensed them the content.

The law being broken has nothing to do with the contract. They can say whatever they want if it's within the terms of the contract.

However, if what they say is illegal, then they can be brought to justice. But they cannot be sued for breach of contract or defamation of character.

Also, what was on their site isn't necessarily illegal and it's open to interpretation. Like I said, the fact that the youngest lover she ever had was 12 doesn't mean or even imply that she was over 18 at the time.

I emailed the photographer and he did indeed sell the owner of the site the pics. He e-mailed her and she personally called me . I requested she remove the wording of me having a 12 year old lover .(.i dont care what state you are in.talking about underage sex and love is just pedophilic) She was real nice and understood where i am coming from. legally she can do what she wants with the pics , that i am well aware of..she agreed to remove the wording.. but can and will leave the mommy role play up there..oh well. wish she would put my banner on "dollys" page..lol..that girl is busy with all the "mommy" freaks..

HRS is pretty rough to deal with. When my son was about 4 years old he got into his bottle of Flinstone chewable vitamins and ate a whole bunch. When we went to pick him up and check him out they said we can't discharge him yet until you speak to the HRS. I was like, excuse me. Why do we need to talk to the HRS. And the station nurse said anytime a child accidently ingests a potentially poisoinous substance HRS has to come in and interview the whole family. I was like you got to be kidding it was a bottle of kids vitamin chews. And the nurse said rules are rules just have a seat and wait.

It took 3 hours for the woman from HRS to arrive and I was going nuts by that time just from the wait. Then this HRS lady arrives and she has an instantly antagonistic attitude towards my wife and I like we're bad parents.

I asked her how long this interview would take and she said however long I decide it will be. That tells you what a power trip this one was on. So she starts asking why we keep pills within a childs reach and I told her we don't he pulled a chair up and grabbed them off the counter. Then she goes why don't you keep your pills closed and we said we did he figured out how to open them. Then she said why weren't you watching your child. And I told her I was in my home office and my wife was on the phone and our son was watching TV in the living room.

Then she really started being ridiculous and goes what other drugs do you keep in your house. Do you have controlled substances like cocaine, marajuana, in your house. At this point I wanted to pop her one right in the face. She goes how many drinks do you have a day. I was at the boiling point cause I don't do drugs and I don't drink liquor.

HRS is called DSS around here (Department of Social Services) and they are the TOP office, no office oversees what they do and there is NOBODY to report them to if there is a problem with them. They are regulated by NOBODY and the courts tend to believe EVERY word they say.

They act like detectives and even tell you that "IF you cooperate with us things will be easier on you" If you refuse to let them in your house, they will get the cops and come in and take your kids period. I knew some good parents and some bad parents who went through hell with them.
