 2257 Question

		I have a few questions...
ref: http://www4.law.cornell.edu/uscode/18/2257.html Under the 2257 law where does it say I have to publish the information online? Where does it say if you purchase the non-exclusive rights to content that you need all the record information? Is their no privacy issues posting peoples pictures/name online? Even without an address that is enough information to hunt someone down. How about plugin content providers? Just some questions.. I looked over the law and it's pretty simple to understand. From what I gather you don't need any of that shit to put online, just have records of it at your place of business, but not each record of every picture only the correct information of where those records are. |

And what about free sponsor content?
	 |

Could you imagine posting that information on line and letting some creep get a hold of a model's phone number?
Dammed if you do and dammed if you don't. |

This law was written pre-Internet so there is nothing that specifically states about online posting...Therefore, it falls under the bold section below. Nobody is required to publish the actual 2257 documentation online, only the info for the custodian of records.
"Sec. 75.8 Location of the statement. All books, magazines, and periodicals shall contain the statement required in Sec. 75.6 or suggested in Sec. 75.7 either on the first page that appears after the front cover or on the page on which copyright information appears. In any film or videotape which contains end credits for the production, direction, distribution, or other activity in connection with the film or videotape, the statement referred to in Sec. 75.6 or Sec. 75.7 shall be presented at the end of the end titles or final credits and shall be displayed for a sufficient duration to be capable of being read by the average viewer. Any other film or videotape shall contain the required statement within one minute from the start of the film or videotape, and before the opening scene, and shall display the statement for a sufficient duration to be read by the average viewer. For all other categories not otherwise mentioned in this section, the statement is to be prominently displayed consistent with the manner of display required for the aforementioned categories." Rochard...Quit fueling the fire with your scare tactics. The fact is, MOST amateurs have a "friends" section in their sites and if all of the friends were to conform and have their info posted as well then it would be difficult for anybody to pick who is who out of the list of multiple custodians. |

Posting any model information online is truley ludicrous. Posting the keeper of the records and where to get ahold of them is really all you have to do. Any other information posted online is voluntary on your part.
	Good luck. -Kel |

Posting the info online for the providers is fine.. We would do that anyway just to be safe.
What about the purchase of content (non exclusive) from providers, money programs (free), and so on? Do I need all the information about the models? From what I see I don't. What about solo models? Can they just put up the basic information and then have them contact the model for more 2257 information? |

The bottom line is that you need to list a custodian of records for any material that is subject to 2257 and this does include solo content in a lot of cases. Nobody cares if the content is exclusive, free, or shot on Mars. Considering our personal conversation the other day, I can not stress enough, the importance of you speaking with a qualified attorney. |

I did talk to a lawyer, she asked me to ask on the board then I showed her the board and she started to laugh at some of the answers some people gave on other posts.
So she had me asked questions in the hope that I would get some non smart ass based answeres. |

Yep, and personally, I have no idea if you wrote anything or not on this, and I don't give a fuck. Talking about people with their heads up their own asses, I would think you need to direct that to yourself. Seeming a few posts up I said no way I could keep track of a 9 page post and all of the other posts, would kinda mean I have no fucking clue who you are or what you have posted. And yet stilll, my question has not been answered. |

Basically, any content loaded in your server should be covered by 2257 statement.

If my lawyer told me to go ask someone else, I'd have 2 words for him/her... "You're fired." Contact one of the industry's well-known lawyers and ask them - they will be familiar with this issue even if your lawyer isn't. |

TheDoc...I would follow Carrie's advice and seek an attorney who knows these things. Talk to J.D. Obenberger from xxxlaw.net. |
