Indiscriminate DMCA of 990 alleged chaturbate pirated recordings

https://www.lumendatabase.org/notices/15046219

Just received notice that I'm included in this list...

The content they're complaining about has existed on my site since before chaturbate even opened. It's not pirated and I doubt it's even anything to do with the chaturbate model.

Looks like they're just doing a search for <chaturbate_screen_name> and <cam_related_keyword> and throwing every result in.

And to further prove how dumb this is... one of the URLs is a record company...

Did chaturbate initiate this?

TheDynasty 09-28-2017 07:32 PM

same here looks like bullshit the url they submitted has nothing on it. in my case anyways i'm using only a chaturbate XML feed
google search console alert popped up and told me i only have one url they sent it at.

JOKER 09-28-2017 08:30 PM

I’m in the same boat.

Read this: https://www.techdirt.com/blog/?company=chaturbate

JuicyBunny 09-28-2017 08:32 PM

We got it too for entirely unrelated content. They had better retract this shit from Google ASAP.

Chaturbate should fire the dimwits pumping out their DMCA notices OR get to the bottom of what is going on. Malwarebytes is popping up when we hit the page.

awxm 09-28-2017 08:33 PM

It's a lot more than 990, that`s just one page.

Great. What a clusterfuck.

Brian mike 09-28-2017 08:36 PM

Got a load of DMCA come in too :2 cents:

rowan 09-28-2017 09:28 PM

Not sure if this is the real Chaturbate (Multi Media, LLC) or the impersonator. None of the dates match the one from the notice linked in the OP, and there doesn't seem to be a way to search the transparency report site for company names.

https://transparencyreport.google.co...porters/174355

Note that the bottom table shows 0% of URLs removed for all claims.

We're going to counter-file with Google and include the techdirt stories url. The one post they are showing for us is not related to chaturbate at all.

j3rkules 09-29-2017 12:40 AM

Now, it is becoming a serious issue. Good luck with counter filing 990 notices...

MattO 09-29-2017 05:38 AM

This morning I got a DMCA for one of my Chaturbate white label sites that does nothing but funnel them traffic. (from lumendatabase.org)

Nice.

Brian mike 09-29-2017 05:49 AM

Steve of CB posted about the issue in this thread

https://gfy.com/webmaster-q-and-fucki...ca-notice.html

I have get reply from google about all my counter notice and no action been taken as of yet they say.

bns666 09-29-2017 05:53 AM

same shit here...

Barry-xlovecam 09-29-2017 05:58 AM

they just go round and round!

Black Hat SEO and DMCA -- who would have thought .... NVM :)

Tjeezers 09-29-2017 06:13 AM

Same here

And i do not even push them in any possible way besides the WIDGET I added on the blog. Besides that, no links, no videos, no nothing.
This is initiated by Chaturbate?

Most probably initiated by CB.

The DMCA should have the name of the person sending it. Threaten legal action.

The DMCA was sent to Google, so us merely affected webmasters are not privy to that information.

rowan 09-29-2017 08:51 AM

You can check your domain here:

https://transparencyreport.google.co...chaturbate.com

(Replace the domain in the URL with your own)

So yeah, by doing that I've discovered this isn't the first time my site has been DMCA'd by the mystery Chaturbate white knight.

CamsEtc 09-29-2017 09:18 AM

In checking the transparency report it seems every major cam site has had a gigantic spike in DMCAs beginning in Aug/Sep timeframe.

It's come to our attention that a malicious and unknown third party has been submitting false DMCA takedown notices to Google. Here are two Techdirt articles about this matter:
https://www.techdirt.com/articles/20...s-update.shtml.
https://www.techdirt.com/articles/20...irt-urls.shtml

We have been working with Google to identify the source of these false notices so that Google can know to ignore them. In the meantime, to the extent that you continue to receive erroneous takedown notices, we recommend that you continue disputing them by sending Google counternotices explaining that these notices are false.

Google has a counternotice form: https://support.google.com/legal/con...ebsearch&uraw=

It?s pretty simple to fill out, here are the steps:

1) Fill in your name, title, company name, mailing address, email address, and phone number

2) Provide a list of the URLs that have received a takedown demand. (Pay attention to instructions and advice provided by Google about number of URLs to provide per notice.)

3) Choose the excuse that applies to your counternotice (e.g., "I am not the owner, but I am authorized to use the content").

4) Read and (assuming they are true for you) check the boxes next to the sworn statements.

5) Type your full name in the signature box.

6) Click the ?Submit? button.

7) Repeat if necessary for additional batches of URLs.

rowan 09-29-2017 06:54 PM

Wonder if this is an elaborate scheme to fish for information. If you submit a counter-notice, the complainant will see your contact details.

incredibleworkethic 09-29-2017 09:29 PM

Steve,

As a promoter of the girls material, it would be nice to respectfully show a short clip or picture without them sending a DMCA to being with.

Promoting their name, pictures, etc, is good publicity right? It would be different if someone kept showing full length private chats.

Anyone else think similarly?

Legally, if a sponsor licenses an affiliate to use a certain group of promo tools they already have, at a minimum non-exclusive copyright licensing of and by the broadcasting party (model(s)).

Quote:

After posting the Materials on the Site or through or in connection with the Service, you continue to retain any such rights that you may have in such Materials, subject to the license granted herein. By posting the Materials on the Site or through or in connection with the Service, you hereby grant to the Site a non-exclusive, fully-paid and royalty-free, sub-licensable, and worldwide license to use, modify, delete from, add to, publicly perform, publicly display, reproduce, and distribute the Material, including, without limitation, distributing all or part of the Materials, in any media formats and through any media channels. In addition to the foregoing license, you hereby authorize us to send takedown demands, pursuant to the United States? Digital Millennium Copyright Act (?DMCA?), to any service provider hosting reproductions of the Materials that have been taken from the Site (e.g., a video clip bearing our watermark).

New affiliate leads, of course! :winkwink: :Oh crap

(This joke probably would have worked better 10 years ago when programs cared about affiliates)
