Pay the monkey -- PETA wins settlement before appeal.
That monkey needs a dental hygienist bad!

PETA are too big for their boots.

That image should 100% belong to the photographer that left his camera out.

I agree. Should fall under the law as if he used a self-timer.

PETA had claimed that macaques were “sophisticated beings worthy of having legal ownership of their own intellectual property.”

Slater said he made the camera accessible to the macaques, hoping they would play with it and take photos, and argued that ownership rights belonged to his company, Wildlife Personalities Ltd., which had published the photo in a book.

Did he ask to use the camera? Did he pay to use the camera? Did he steal the camera?

TheDynasty 09-11-2017 08:15 PM

Resident Gfy Monkey?

pornlaw 09-11-2017 09:29 PM

The photographer ran out of money... PETA didnt...

Rochard 09-11-2017 09:37 PM

Sorry, only humans have such rights.

If I set a up a motion activated video camera and it captures a deer in my yard, do I own that copyright or does the deer?

RyuLion 09-11-2017 09:56 PM

AHahahaha

He should have found a new law school graduate. And Barry has turned into Bladeliar III; that isn't what happened.

The monkey clicked the shutter with its fingers; a deer doesn't.

CurrentlySober 09-12-2017 01:30 AM

Side note: Monkey has more and better looked after teeth than I do... :(

Barry-xlovecam 09-12-2017 05:25 AM

And Baddog is what he is -- a miserable old man.

I could give 2 fucks of what Baddog thinks of me -- you are irrelevant to me.
----------------------------------------------------------------
The monkey used a tool (a camera) and mimicked the human behavior observed apparently. That shows the intellect of a human toddler perhaps. The monkey gets 25% of the image revenue -- the monkey played an active role in the photography (<producing a selfie>)

-- that was the settlement -- the monkey's recipient being some foundation for the benefit of monkeys.

So, argue why the performer should not receive royalty revenue if he didn't sell his copyright. PETA found a new revenue stream maybe.

The money took the picture of himself -- the man didn't take the picture of the monkey < that was the point of the lawsuit.

MLM: Monkey Lives DO Matter :P

Deer Lives mathers :winkwink:

Barry-xlovecam 09-12-2017 05:47 AM

The deer cannot work the camera -- the monkey did -- you miss the whole point.

That is the difference between an animal and a monkey. Monkeys have a thumb (like men do) and can use tools (like men do). Monkeys also throw poop -- men have evolved to talking shit (more or less the same behavior) :P

Monkey Powa :laughing-

Paul Markham 09-12-2017 07:17 AM

Stupid decision.

MedCash_Miller 09-12-2017 07:46 AM

god... PETA activists really know how to spend their time.

pornlaw 09-12-2017 08:35 AM

The photographer won the lower court cases... monkeys cannot own copyrights.

He now owns the copyright free and clear and has agreed to donate 25% of the future profits to PETA...

PETA settled because they know they were going to lose and wanted to get something out of it. The photographer settled because he was broke...

What a disgraceful ruling. All responsible are completely incompetent.

edit: nevermind, I see it turned out OK in the end. Although the lawsuit should have been thrown out.

Just making sure Bladeliar III sees that part again.

TheSquealer 09-12-2017 09:11 AM

cliff notes;

Barry doesn't know what "settlement" means.

I wonder if the original Barry sold his account; I remember thinking he was smarter than he has come off over the past 10 months or so.
