Rented out a very Nice Penthouse Loft 2 bedroom with den high celling , a Large balcony for my little family since july 1.
My wife and i have been careful with our money the last few years but have decide to threat our self with a Luxury place until we buy our house with in he next 2 years. :thumbsup

Yeah.... My wife and i smoke weed on our balcony ( never in the house ) But that stupid idiot above have decide he is now mr. Justice and plan to bring a motion to the next condo board meetting about a total property smoke free. :1orglaugh :1orglaugh :1orglaugh :1orglaugh But....... today My landlord show up for a visit after their board meeting and informed me the guy above have been filming my wife and i smoking Weed on our balcony. She say she seen the video and was asking me if it was and i say hell yeah. ( Her personaly have no problem with this I respect the lease no Smoke in the Suite etc... Im allowed in my lease to smoke on the balcony same as the condo by law allowed it. :thumbsup . That fuckers Still filming me from his master bedroom very possible the way it is build. Is there anything Legaly i can do about this ?

Yeah of course in the morning contacting a lawyer but if anyone have been in this situation before what have been the outcome ?

The balcony is classed a common property and a neighbour can complain about smoke drift, especially if the building has a clause about non smoking in common areas as most do, you can be booted out on the spot for it.. health hazard endangering the lives of others. And that's any smoke, cigarette's, pot or bbq.

I live in city apartment, smoke like a train and I'm always out there.. learn your neighbours habits and smoke around them ^^

In Edmonton Alberta with the tenant board and City By Laws they turn that smoke rules/ law to be decide/ ruled by the condo board / owners. Here our balcony is part of the dwelling they called and is not consider a public area but part of my house aka 5 meters rules dosent apply to balcony is not public area. Of course there is a big sign beside entrance about no smoking with in 5 meters of the building etc.. But in the house and balcony is consider here as part of the unit. ( My landlord her self told me that :1orglaugh) . The way she explain me this the condo board have not plan any ruled about smoking becaus no problem have EVER arise. LOL Fuck me GREAT lol

The owner has the right to use his property. If your nasty smoking habit bothers other people living in the apartment house, you restrict their right to use the property. By law, you are not allowed to bother neighbours with smoke, dust, noise, odor, trash etc. It doesn't matter that smoking is allowed in the apartmen house. There are laws protecting non-smokers (thankfully) and then the civil code.

As a non smoker I fully understand him.

Unless Edmonton has special laws , your balcony is a COMMON AREA with exclusive usage by you , just like your EXTERIOR walls .... So by-laws of the HOA applies to your balcony ...

Your entrance is a straight forward COMMON AREA as it is not used by any single owners.

Seems like in the eyes of the city bylaw im in the wrong because non medical Marijunana its considered illegal still in Canada until next year. :upsidedow

But is up to the Landlord to apply smoking or not on the balcony because it is part of the unit and the lease apply only as to what i can do or not.

( no rules from the condo board bylaws about smoking BUT they can apply it anytime if the motion go through if they reach 75% majority of condo owners) FUCK ME :1orglaugh

2- Call and research on City by law on their website
3- Read and reread my lease
4- Call again City of edmonton to know where they stand
5- Call tenant board

6- Call the police station ( telling them i smoke weed on balcony are you going to arrest me ? )
Their answer is is there any emergency sir ? i say no. they say we dont go on call for private use of marijuna in their home :1orglaugh

7- Did some reasearch about medical Marijuana License

Did all those research because if i plan to sue the condo board and the tenant above me for harrassement, discrimination, and the so on LOL, i can added im black too :1orglaugh racist ? ya know ... Fellow weed smoker here, but I have to disagree with this sentiment. Why should my neighbors have to keep their doors and windows closed and not get to enjoy a nice breeze or a sunny day just because they don't want to smell my weed?

Luckily, I live in an area where I can sit out in my backyard and smoke if I want and nobody is close enough to smell it, but if they could and they complained about it, I would try to come up with a solution that we were both happy with.

I read the rest of the thread and it sounds like you have impossible neighbors, but that I still think they shouldn't have to close up their house just to accommodate you.

Yeah, the shatter/wax/oil is a bit much if you're trying to be remotely productive. You can get a box vaporizer for dried marijuana for like thirty bucks. You'll use about half of what you'd pack in a bowl/bong and the high's a lot cleaner.
