What does your government think about porn?

If Ashhahahahaha starts breathing down the industries back I want to get my ass out of here and Australia is at the top of my list.

BRISK 03-29-2003 06:07 PM

If A S H C R O F T started cracking down on porn, it's not so much where you live that matters as much as what country your server is in. So even if you move to another country, your server is still in the US and under US law.

So I think it would be more important to move the server to some country like Canada or Netherlands or UK than for you to move yourself.

Mutt 03-29-2003 06:16 PM

you're mixed up. Over and over the law in most countries is using your residence as the determinant whether you can be charged with a crime involving the Internet. You can set up a corporation off shore, set your servers up off shore, but you better be ready to physically move yourself with them.

If you are a resident of the United States and want to run an online casino or sportsbook there is no legal way to do it unless you leave the United States and live elsewhere. There are guys in jail right now who fought this and lost.

BRISK 03-29-2003 06:23 PM

But if you just move yourself to another country and keep your porn servers in the US, they could probably order your hosting provider to take down your porn domains.

I guess the best solution is to move both yourself and your hosting outside of the US.

If your servers are offshore, and your processor is offshore, and your corporation is offshore, it would take a near act from god to expose who you are.

That's what I was thinking.

This is correct. They might just might go get your ass and bring it back to the USA also. But usually wouldn't have to because most people
"Think" after a few years it's ok to go back home, just keep a low profile... Hello..

This is also true. I would think what country you were Inc. also, what kind of agreement they have with USA.

Two Words:

Patriot Act

They've only just begun using this to find out anything that you think you have hidden. Give it a couple of more years and they'll be phoning to tell you to cut down on T.P. usage each morning. :1orglaugh

Our government doesn't like porn that much, although you can get hardcore in the A.C.T. (Australian Capital Territory) and the Northern Territory. But its effectively banned in the six states. Of course you can get regular porn (Penthouse, Hustler) anywhere and there are sex shops in all major centres.

But when it comes to hosting porn - it's simply not allowed. All Aussie webmasters host offshore because we have to. Sometimes this country still reeks of the prudishness of our Mother Country, England. And I fucking hate this aspect of our culture. But you can't beat the lifestyle down here so I'm staying as long as I can continue to host elsewhere in the world.

Aussies host in other countries because it's cheaper, not so much because porn is illegal in Australia.

NEW YORK (AP) - A federal appeals court has upheld the conviction of a San Francisco man who operated a sports betting business on the Internet, concluding that the business engaged in illegal gambling.

Lawyers for Jay Cohen, 34, formerly of Woodmere, N.Y., contended that Cohen did not break the law because his business was based in Antigua, where betting is legal. They also argued that New York, where many of the customers lived, allows certain types of wagering, such as off-track betting.

But the 2nd U.S. Circuit Court of Appeals rejected the arguments, saying betting was clearly illegal in New York.

Cohen was sentenced a year ago to one year and nine months in prison. The conviction came in the first use of the U.S. Wire Wager Act to shut down an Internet gambling operation, prosecutors said at the time.

Mark M. Baker, a lawyer for Cohen, said he was disappointed by the ruling and would appeal.

``There are about 800 web sites out there right now doing exactly the same thing as the World Sports Exchange and it doesn't look like any of them are being criminally prosecuted,'' Baker said.

Marvin Smilon, a spokesman for U.S. Attorney Mary Jo White, said prosecutors had no comment.

Yes, it is cheaper but you still cannot host hardcore in Australia. Try it and see what happens.

I'm not planning to host in Australia even if it was legal. I don't feel like paying $3/gb

The Other Steve 03-29-2003 09:03 PM

Joe is absolutely right about the hosting - you would have to be insane or clueless to host here in Australia - they can shut you down in a few minutes.

As for shooting hardcore - the only places that it is legal to do that is the ACT and, of all places, Tasmania.

Big Nath 03-29-2003 09:42 PM

yeah lifestyle way australia is the way to go.. I live in Queensland, and it is absolutely beautiful here at the moment..

I host all my stuff overseas too, not because its cheaper, and not because its illegal, but the lines between australia and the rest of the world are slow as all shit. We are very underdeveloped here with regards to broadband..

You yanks and asians have got it really really good. My ISP bills are up around $3K this month.. Not handy !! :321GFY

$3k a month? What the fuck kind of connection do you have?

You can get DSL/Cable in Australia for $40 USD a month, how do you manage to pay $3000 a month for an internet connection?

The Other Steve 03-29-2003 10:06 PM

yep enquiring mind want to know :)

I've got dsl down here and I'm working it to death 16 hours a day for a couple of years and my biggest bill so far has been less than 300.
