Is NIGHTSURF abusing CYBEREROTICA and other TRADEMARKS?

When I search for

cybererotica
adult check
karas
adult.com

on http://search.msn.com

and many many more

I get:

You have entered a search term that is likely to return adult content.

Click here for search results on 'adult.com' at NightSurf.com
NightSurf.com is an independent adult search service.

Warning: If you are under 18 or live in an area where it is illegal for you to view explicit content, please revise your search.

Are they abusing trademarks?

angelsofporn 03-26-2003 08:49 AM

yes these guys are con artists
whether you search for blacks on blondes, Angels of Porn, Cyber erotica...alll take you to ifriends..it's totally untargetted and robbing people of their brand names..msn needs to can these idiots

mpegposter 03-26-2003 08:50 AM

Nightsurf is run by ClickCash/IFriends and they have purchased any spots of that type. So while it is shitty, they are at least paying for it in accordance with the SE rules, not stealing it like common thieves.

:2 cents:

web4x 03-26-2003 08:55 AM

But why did MICROSOFT sell them trademarked keywords.

I don't understand it.

PornBroker 03-26-2003 08:59 AM

It's a way for ninemsn to keep an arms length from
adult, while still get paid per click by Webpower.

Paying MS to let them cash in on someone elses trademark does not make it any less of a theft.

You'll find the same result from 'adult sex' as 'adult.com'
Once adult terms are typed in and you are passed to Nightsurf, it ceases to be a SE and becomes just an Adult portal.

DaDee 03-26-2003 10:43 AM

thats for sure!

web4x 03-26-2003 11:41 AM

Some lawyer should stop this trademark abusing.

AmeliaG 03-26-2003 01:09 PM

Ah, I wondered why they never answered my ad rate queries. All becomes clear.

web4x 03-26-2003 01:26 PM

How is that trademark abusement? Is is saying do you want to search for "adult.com" at Nightsurf.com. Not that the results are on adult.com's site.

clueless

Tipsy 03-26-2003 06:55 PM

The only thing I find odd is that so many didn't know about this especially when the guy starting the thread considers himself a bit of an SE guru :)

DamnGoodRatio 03-28-2003 02:38 PM

No, you are only abusing a trademark if you are using it to sell a similiar product, with the intent to deceive.

Note the qualifier, "Click here for search results on 'adult.com' at NightSurf.com." They do not say there will be content, just that you can look for other content on Nightsurf.

Can't blame them, if I had that much money I would do the same damn thing.

utter dickhead

chodadog 04-05-2003 07:19 AM

I don't see anything wrong with it. For example, what if i had a mainstream website, and i only dealt with mainstream searches? That is, there are no adult results within my index. Should i just show them a page saying "no results"

Or should i send the surfer to a page that actually has something somewhat relevant, AND get paid for it? You can bet your ass i'd do it. Some of you people need to stop bitching.
