Someone Emailed me wanting to stop using their trademark
It seems they have a UK trademark according to the IPO under class 41 services.
There is another company with the trademark under products. We don't currently offer any services that the complainant has listed and certainly don't produce a product. IMO, the complaint is due to being outranked in SEO. Obviously he was #1 and then we came along and knocked him off. Should I be worried? |

Did you start using the domain before they filed the trademark?
|
Get a new domain name and 301 the old one too it. Problem solved.

In theory a trademark applys to a specific trade with the exception of well known trademarks (Microsoft, Honda etc) however the law is a messy Bitch and they could cause a lot of trouble and cost to you even if they are in the wrong.

Tell them to eat shit and die.
Should you need legal representation I will be happy to represent you. However, please note that I am NOT an attorney, just an angry fag. |
It's not a domain name that is the issue. Our business is a 2 word phrase. It's not like Google or anything. It's more like "Good Luck!"
We do have a domain as well which includes the phrase but the email doesn't specify stopping use of the domain. We have this two word phrase above our shop and on all marketing materials. |
"good luck" ?
That's pretty vague if it's something like that. I don't know for sure. I'd ignore it for now and see. If they are persistent then determine their threat level to you - cost etc... Then if you still want to keep your domain ask a lawyer for advice and go from there. |
