The issues with 2257 as the courts recently noted is that it amounts to a warrant-less search.
In a broader scope it also shifts the burden of proof from the prosecution to the defense and it completely destroys presumptive innocence. I am as much against CP as anyone can be but 2257 is NOT the proper way to do it, nor is it the most productive way. |
