Couple sues Air Canada: Ordered 7-Up, but served a Sprite.

This was on TV the other night...

Supreme Court rejects payout for couple who wanted to order 7Up in French.

When Lynda Thibodeau asked in French for a 7Up on an Air Canada flight from Canada to the USA, she was served a Sprite instead by a unilingual English attendant. Lawsuit!

how can you demand that everything needs to be bilingual when you speak yourself only french? i don't get that.

brassmonkey 10-29-2014 01:35 PM

just great!

Rochard 10-29-2014 01:35 PM

What kind of nonsense is this?

We should encourage people to file such lawsuits. And then charge them $100k in fines if the case is lost or rejected by the court.

Klen 10-29-2014 01:37 PM

There should be counter-litigation by both the respondent and the clerk of the courts when a lawsuit is rejected.

Both for costs and for the respondents case damages to reputation. If these actions were pursued and/or were a real consequence of filing actions like these there might be less costs on the part of the courts and fewer cases of a frivolous nature.

1 commenter noted this seemed to be more about which beverage company supplies the airline than it does about language rights.

Another commenter notes that the male in the couple sued the airline for a similar uni-lingual issue resulting in him being removed from the plane in 2000 and being awarded almost $5,400.00 by the courts. He said these were people that prey on businesses with these type of cases.

I was a bartender in DC for a bar that got sued by Coca-Cola for serving Pepsi in their rum & cokes...

We had to print "We Only Serve Pepsi Drinks" on our cocktail napkins as part of the settlement.

That one I get... This one I don't.

How does someone who lives in a trailer park in Qweebec save enough money to fly AC?

Mutt 10-29-2014 04:31 PM

What were they doing travelling to the US 3 times if being served in their own French language is so important to them? No French service available in the US. Always a one way street with the Quebecois, they don't give a shit about English language rights in Quebec.

Wimpy country, should have never caved in on anything with them, let them try to separate, when they do just roll the tanks in - the insurrection will last about a day.

The guy who brought this lawsuit is a douchebag looking for a payday, nothing more.

How did it make it all the way to the Supreme court? Should have been rejected immediately.

Much more important, and interesting for me, was the part that Air Canada must uphold "linguistic rights". Is Air Canada a private company? Or government owned?

"In a 5-2 decision Tuesday, this country’s top court ruled there is no dispute that Air Canada violated Michel and Lynda Thibodeau’s French-language rights during three international flights in 2009. However, the Supreme Court justices found the couple did not qualify for monetary damages.

.......

Though a majority of top court judges ruled that financial compensation wasn’t appropriate in this case, the judgment reaffirmed that linguistic rights “are essential to the survival of our country and they need to be interpreted generously,” lawyer Ron Caza told the Citizen. “That’s huge for us.”

WTF are "linguistic rights" and if Air Canada is a private company, then how can someone force someone else to speak a certain language when serving customers????

.
