Can i post pics of people on a site without a release form if they arent nude?


like say i walk into my local resteraunt and see a hottie bartender, i snap a pic of her pouring a drink and slap on my site ...

Do i need a release?

Depends where you shoot the picture. In some public places its allowed. In a restaurant, probably not. In general, protect yourself, get permission from the person being photographed in writing.

i just want to take pics wherever i go and put some on a site.

say i go to six flags and see a hot milf walking with her kid. She bends down to pick something up and *CLICK* i get a shot.

Well you don't need a release for her, but you need her permission to have the kid in the picture. It's illegal to post pictures of a minor without parental consent. I got in trouble for that once back in high school. Damn PTA will do anything to fuck you :321GFY

So ill walk away from this asuming its ok to snap public non-nude pics and build a site with them (providing theres no minors involved) unless someone wants to correct me? lol

From what I have been told, posting a pic of someone on your adult site without permission aka model release. Whether they are dressed or not you are asking to be sued.

I agree with tony404. Take a photo, put it on an adult site and you are just asking for a lawsuit.

If you are charging people to see the photo, that makes it a commercial practice. There are a lot of variables, including whether a person might reasonable assume that his or her photo would be taken, say in the stands at a football game.

In a bar, I don't think so. In fact, that is private property and you should actually have permission of the owner of the building and proprietor of the bar before snapping a photo...although that's probably not as big a deal.

I've written about this before on GFY, but it bears repeating.

If you take a photo of someone, in most cases you will own the copyright of the photograph. But, they retain rights to their image in most cases. I mean, if they are not a "public person" such as an actor or politician, they pretty m uch have a right to privacy in the situation you are describing.

Do yourself a favor, either get a release of don't use the photo.

If you look on tickets like at a sports event or rock concert. You waive your rights with use of the ticket, it says it on the ticket.

Looking at your understanding, I would say the overall answer to your question is "No." You can't shoot your own content. You don't know enough to not get your ass in trouble. Play it safe.
