The US patent office just ruled that the Washington Redskins name is derogatory to Native Americans and therefore voided their trademark!

I think they should have known that the handwriting was on the wall some years ago and changed the freaking name already.

My point is that NO one uses the term in this way. When people talk about a Redskin or the Redskins everyone assumes you are talking about the NFL team.

Not too long ago it was in the news that the District of Columbia thought the name was offensive and wanted them to change it. They declined. Obviously this is a political attempt to force them to comply.

I've always been a 'cut off my nose' type of guy, but I think the Rhode Island Redskins has a nice ring to it. I'm sure there are several states that would love to have a local franchise and the tax revenue that comes along with it. Not that that would change anything, but if I were Snyder I would be wondering what kind of pressure they would apply next.

This is the second time it has happened. In 1999 it was cancelled and then in 2003 it was reinstated by a Judge on appeal.

They still have a common law TM for it - it just won't have federal protection of a famous mark. It really just means they would have a little more work to do in a legal sense to enforce it.

It doesn't mean they are forced to charge their name or even that they couldn't protect it.

The Philadelphia Eagles SB Nation site (Bleeding Green Nation) has a section devoted to Washington's team and calls it LOLskins.

We also refer to them as the Foreskins, but as was pointed out in the comments of BGN's article on this subject, the "Foreskins" name may be offensive to those who have been circumcised.

I don't know if that's without risk of being sued.
You don't have to use a trademark to infringe "in likeness".

For example, making a commercial with a football team called "Pigskins" to sell you pork rinds
and dressing the team like the Redskins is not going to fly.
They wouldn't need a trademark on Pigskins to win a suit like that so why would they need a trademark on Redskins?
