Moniker Has Blocked My Domain Without Prior Notice Nor Legal Basis

The title says it all. I am still waiting for their customer service to response.

Hello,

Moniker has recently engaged Legit Script as a 3rd party auditor in order to locate domains involved in the illegal online sale of drugs without a prescription and/or the sale of unapproved or falsified medicines.

The domains below have been deactivated and removed from your Moniker account due to a violation of Moniker Terms and conditions as well as violation of The Uniform Domain-Name Dispute Resolution Policy Section 2d. (http://www.icann.org/en/help/dndr/udrp/policy) If you feel this decision was made in error, please contact Legit Script at the following email address: [email protected]. The Legit Script team will review your dispute and if it is determine that you are not in violation, your name will be reactivated and returned to your account.

Sincerely,

Since I am still waiting for your response. I decided to submit my request here directly to customer service.
The issue is about Case: XXX

To Moniker and everyone who may be concern,
Those are false accusation of the search engine results keyword
competitors in order to harm competing sites for top keywords in
Google rankings.

You should have consult me before taking my site down before I had a
chance to reply to this.

Here is how the situation looks like:

1. First of all my website was not selling any medications. My website
was only 1 page html homepage for getting Google traffic. The
subdomain of that domain was linking to external pharmacy store.

There is no break of any laws here.

2. The company to which my site was linking sells genuine generic
medications and they require prescription on all times. And no orders
will be processed there without valid prescription if the customer
country laws require it (edtabs-solution.com/faq-us.html this is their
store I have been linking to you can see on that page yourself they
require prescription) No orders will be processed without valid
prescription.

3. The company to which I have been linking is more than 10 years in
this business and they are fully legitimate.

4.
LegitScript is informal organization and not law forcing agency.
Their business is to protect US pharmacies from competition.
I'm quite convinced they did not take any care to check the legitimacy of this actions and they just automatically sent you a query.

And once again my website was not a pharmacy itself but a page to gather traffic that I have been sending to legitimate pharmacy.
There is no law that forbids it.

What else would you like to know?
Do you have any valid legal basis to block my domain? If yes I would appreciate if you present it.
I would appreciate your response as soon as possible,

As far as I can see the pharmacy in OP does not sell any controlled substances.

"I wasnt selling drugs!" -said every drug dealer who has ever lived.

It's interesting that the OP wasn't operating a site with an online pharmacy, but only linking to one. Plugrush has ads for Viagra. Would Enom consider that involved in the illegal online sale of drugs without a prescription? Would websites distributing those ads also get deleted?

OneHungLo 02-24-2014 04:52 PM

My guess is you're probably linking to some 3rd world shithole illegal pharmacy and moniker is cleaning up / taking out the garbage. I mean, that shit is pretty much on the same level as Chinese counterfeiters :2 cents:
