Guys, are there any lawyers here that could help me with small claims? I was about to sue a company based in Florida. Thanks!

I won in small claims court once.

Our apartment complex failed to give us back our our deposit because they had to hire a company to clean our blinds. We did clean the blinds; We went so far as to pull them down and clean them by hand. It was hot that day, and my room mate was wearing a short pair of shorts and she was looking hot and bending over on her hands and knees cleaning... So I took some pictures.

The pictures had the date stamp on them - this was back in the early 1990s before photoshop....

I went to court with pictures of us cleaning the apartment, and the apartment complex showed up with a hand written generic receipt of a company that didn't exist.

go to the courthouse.. there is a civil center that will walk you through the process for free. They will even walk you upsatirs to make sure you file the paperwork correctly. Save yourself the attorney fees. It will not cost more than $200 to file a case for $10,000 or less.

Pasco County, Florida uses a sliding scale that varies greatly percentage wise based on the amount you are attempting to recover.

$1.00 to $100.00: $ 55.00

$100.01 to $500.00: $ 80.00

$500.01 to $2,500.00: $175.00

$2,500.01 to $5000.00: $300.00

That is a lot considering the amount someone is attempting to recover. Example, if you are trying to recover $750.00, your filing fee of $175.00 is roughly 23% of what you are trying to recover in the first place! And that does not include the $17.00 fee on top for preparation of summons. If the amount in controversy is higher, for example $4,000.00, then the fee of $300.00 is just under 8%. That may be easier to justify in terms of cost, but is still a good chunk of what you are owed.

The fee is usually recoverable, on top of the actual damages - in most jurisdictions anyway

In a matter of jurisdiction and venue. If one party does not reside or have a real presence in the state you will have an uphill battle for jurisdiction

You always sue for damages plus court costs in your initial Claim for Relief
