4 letters in a domain got me sued, help please.

I have an 8 letter domain. It has 4 letters in it that spell out the name of a famous musician/band. The site is an adult entertainment site. Has nothing to do with the music industry what so ever, never has, never will.

The band is suing me for trademark and copyright breaches. They went to Warner International and are really pursuing this. There was no intention to use the 4 letters, its a mere coincidence. it is impossible to confuse the two.

It's like godaddy suing gofuckyourself for using the word "go", or vice versa. Ridicules.

Do you think these guys stand a chance? I did a lot of research and there really isn't anything they can do from what I've read. And I can think of at least 15 sites or organizations that use the 4 letter combination.

I'd appreciate any advice. They emailed me and CC'd my registrar, Godaddy.com. And I'm worried how godaddy might react to this. They cant shut me down unless it's proved right?

Thanks guys.

first calm down, millions of people get sued a day.

Second get a attorney that knows web law and youll be just fine

BigFrog 03-04-2003 01:20 AM

in the end all that really matters is this:

#1 you still get to keep the domain

and

#2 you were smart enough to try and get some publicity out of the whole thing. traffic :)

I got sued once for 7letters that were part of a domain, I ignored the letters until the domain lapsed and then sent them a letter telling them not to harrass me again. I haven't heard from them since.

BluMedia 03-04-2003 01:41 AM

I don't see how they could win if the letters is their name that is just ridiculous.

BluMedia 03-04-2003 01:44 AM

BTW if goaddy.com did anything without some sort of court hearing and switched your domain to this other person you could sue the shit out of them. I douct this would happen but you never know. I would hang onto the domain, fuck them they would not win that domain from you.

Even Coka Cola had to buy their domain back from someone..
A Domain is YOURs even if it's the same as a band,
a business or any other thing..
It's just tough shit..First come, first serve..

Last time the band threatened to sue me over "their domain",
they ended up buying it for $2500

LMK and I'll hook you up with Florida attorney who does domain disputes for a living

Go ask Madonna and the charity with the same name about that to see how very wrong you are.

Something with Kiss in the title. Mr. Simmons is all about protecting their "Brand".
