Soneone else commits a crime you do the time

This is very interesting. Two 17 year old boys charged with a young girls ignorance.

We are living in the wrong nation when you can be charged with crimes that others commit.

I have tried to stop many from driving while drinking and told to fuck off.
If the authorities knew this, I would be serving a life sentence.

I actually agree with this law...we all share a responsibility as human beings in keeping our streets safe if not by acting then at at least by reporting crime...driving drunk is a heavy crime...

I am all for group accountability...if a group of people are present while, for example, two people are fighting I would consider it fair that the law holds the friends accountable for at least not trying to stop the fight...

not all cases are black and white and the judge should be able to acquit at his discretion, but the general principle should be enforced as fairly as possible...the two boys should have reported her at least...its not being a rat its being a human being, a true friend....

Yep, this is why no one wants to get involved in this sue happy country with soulless lawyer eager to make money doing nothing except using unjust laws to get rich.

Why offer to help someone when it can fuck you over in the long run...no thanks. It is no longer to use common sense in the USA...it only gets you fucked.

Want to survive here in America...forget common sense and just become an asshole...you will get along just fine.

No way, this is bullshit and certainly should be overturned. As the California lawyer in the article commented, you can't hold someone accountable because they don't try to prevent someone from pulling a trigger, and you can't hold someone accountable if another chooses some other reckless and illegal action.

Now I DO agree that a driver is accountable and responsible for only driving people who wear their seatbelts. But I'm not going to give people drug and alcohol tests or even JUDGE offhand whether they're "drunk" or "high" if I see them driving away after dropping me off. They can go fuck themselves on this one, that's one of the most ridiculous "laws" I've ever heard of. Almost as bad as calling a corporation a person and calling money speech.

bronco67 12-07-2013 02:42 PM

That's a bunch of bullshit. Anyone who kills themselves is responsible for their own death. Also, these two are 17 years old -- and who could expect them to make the right call?

mozadek 12-07-2013 02:45 PM

This is ridiculous, I bet if the genders were reversed she would not be charged with any crime.

sicone 12-07-2013 03:00 PM

We are a country of so many twisted laws that you are fucked if you do, fucked if you don't.

The was a recent case of a sober girl, going and picking up her drunk friend at a party to drive her home. She got in trouble too for encouraging underage drinking by providing s sober ride. I'm sure one of you GFY detectives can find an article or 2 about this.

And then you have these 2 who don't do anything to stop her or help her get home safe and they too get charged with shit. However, I do feel that if they were the ones that supplied the alcohol, then yes they are in part responsible. But I have no clue if they did or not.

Bourke 12-07-2013 04:27 PM

why can't they drive between 11pm and 5am? wtf is that?

Jel 12-07-2013 05:22 PM

slightly off subject, but kinda not - if you are considered incapable of driving while drunk, why are you considered capable of making the decision to drive drunk?

I've closed the window now, but didn't it also say one of the 17 year old boys had been drinking? Yet he is expected to make not only a judgement call on whether the girl could drive or not, but to make that decision while under the influence of alcohol?

Reminds me of thw final Seinfeld episode with The Good Semaritan law

L-Pink 12-07-2013 05:34 PM

3 drunk minors one way over the limit should be the only thing being reviewed here.

"Modlesky?s blood alcohol content was 0.27?more than 13 times the legal limit for someone under the age of 21."

.

This case is a good example of why one should NEVER talk to the police. The only reason they are being charged with any crime is because they explained what happened and gave the police all the evidence they needed to figure out what crime they might charge these guys with.

Rumbledog 12-07-2013 08:00 PM

Jim Gunn is 100% correct. Bingo!

welcome to merica

This kind of BS happens, then you have bankers who caused a world of shit with their Wall Street gambling, affected millions of lives nationally and globally -- and there's probably more than a few deaths related to their mess -- but none of them are in jail.
