Question for the legal wizards
I was sentenced to probation. The probation officer is going to make me to do a treatment program. This is NOT in the order of probation or any of the paperwork. Can they make me to do a treatment program??
Just looking for opinions since I can't really go and see a lawyer. |

I was sentenced to a drug diversion program once (Just weed, nothing else..) but I didn't go and had to go back to court. I was high in court and didn't know what to say, so I said "They wouldn't let me register."... This somehow confused the court and they threw it out and I left with nothing on my record.
The best part is that the cops and mayor that I passed while leaving said "I'm glad you're not smoking anymore, Mike" :upsidedow I wouldn't recommend that, though.. |

I remember a person I know that recently died just after turning 30 from sleeping pills and alcohol, managed to plea a sentence down to weekend jail.
He managed to fuck that up and got sentenced full time. He deserved it. |
this is coming from someone with a deep hatred of police, courts, probation service, the whole 'system' - stfu and do your fucking time, in whatever form it is.
Nothing worse than a whiny ass fuck that got caught doing whatever it was, and outside of murder, rape, extreme violence etc fair play if you wanna do whatever it is you did, but jeez man up and take what comes your way when you get caught. Part of probation is doing shit they make you do even if it's hanging about like a cunt while they are 20 minutes late for every appointment - it's the way the system works, and you know it. Grow some balls, it's embarrassing reading your shit like you can't handle it. And give up whatever it is you got caught for, assuming it's different to the drink-driving you were whining about last time I was stupid enough to click one of your threads - you sound like the kind of bloke who will last about 9 days in prison. |

It seems if it is not court ordered or included as a requirement for your probation then I can't see how he can make you go, but as was suggested I would have a lawyer talk to him about it in order to get out of it.
That said, if it were me personally I would ask him why he thinks I need this since it wasn't court ordered. By doing this you can tell if he is just busting your balls or trying to help you. If he thinks you have a problem, maybe a treatment program isn't such a bad idea. |
I will re-inforce. If it isn't court ordered you don't have to do it. (been there) and even if it is court ordered-you might not have to do it. (just got lucky) The court sends celebs to jail on DUIs for 90 days and they are out in 2.
However MFM is right - most civilian servants won't make time for your lawyer - I would recommend you always have your shit together - for each meeting you might have after sentencing with anybody outside of counsel so that you can refer to THEIR OWN paperwork. They are 99.5% more likely to believe something in black and white than they are some person across the desk from them... so just be ready to show them where it said x days and not this or that. |
