Coming in your house without a warrant
I have seen this come up at least ten times but this is nothing compared to how they abuse this.
Last month my girl and I stayed up all damn night, about 5am we finally lay down and I hear a loud knock and can see flashlights so I figure it is the police. I open the door and they ask if Melissa is in the house. I say no and they still want to look. I tell them she is my xgf from at least 5 years ago. One of the other cops says he sees a girl moving inside the house. I say yeah no shit it is my girlfriend. They had no warrant or anything and were looking for Melissa for something minor and not even a felony. They tell me I can let them in to look or they will put me in the police car and then look. I start to tell them to kiss my ass and do not even get 2 words out before I am cuffed and 4 cops are in my house. They ID my GF while the other 2 look in drawers and every single thing in the house. I said a few times she cannot fit in the freezer yet they still look anyway. They even questioned my GF on things that had nothing to do with the one they were looking for. I had to tell her to shut up. Thing is they will come in your house if they want. Even if they are looking for someone who was said to be there 5 fucking years ago. I was pissed and Melissas mom is a real cunt so I sent them to her house and said she lived there LOL. They did the same to her mom because she emailed me all mad haha |
Yet, if your home alarm goes off, the cops can charge you for service, weather they showed up or not, happened to a good friend

that's messed up.. the problem with that is they knowingly break the law in cases like this banking that you wont go through with filing a formal complaint...

They can pretty much do whatever they want these days. Not much you can do other than comply and do whatever they tell you to do, or they will find a reason to charge you with something.

Most likely in the form of a written apology at minimum. Too often people simply let it go as they do not want additional harassment from 'the law' once balls start getting busted. :disgust |

No one can come in your house (private space) without any printed legal reason! If someone did that you can start with selfdefensing , becouse first that its human instict and second and most important is that you have the ultimate right in the world to protect your home and your family if someone that you didnt know comes in your private space!! It was the 2nd time this year they did this. They are not allowed to arrest me for the drugs they see in the house but they see them and could make my day worse by fucking with me. Next time I will set a pound of weed on the kitchen table while they look LOL.

They did not just bust in. They said they were going to check no matter what though and the fucked up part was I said I would yell for my gf to come to the door so she did not get woke up by a bunch of dudes and freak out and they said no not how it works.

I dont understand how they can just come in unless they see you committing a crime, like a drunk driver hopping out of the vehicle then going inside the house to avoid getting caught. I would call a lawyer and tell them your story and see if there is any recourse. In that situation I wouldn't feel bad about suing at all.

There are four main circumstances in which a warrant is not required for police to search your house:

For example, if the police are in your house on a domestic violence call and see marijuana plants on the windowsill, the plants can be seized as evidence. 3. Search Incident to Arrest. If you are being arrested in your house, police officers may search for weapons or other accomplices to protect their safety (known as a "protective sweep"), or they may otherwise search to prevent the destruction of evidence. 4. Exigent Circumstances. This exception refers to emergency situations where the process of getting a valid search warrant could compromise public safety or could lead to a loss of evidence. This encompasses instances of "hot pursuit" in which a suspect is about to escape. A recent California Supreme Court decision ruled that police may enter a DUI suspect's home without a warrant on the basis of the theory that important evidence, namely the suspect's blood alcohol level, may be lost otherwise. So what should you do if the police show up at your house "just wanting to look around?" It's not in your best interest to deny them access because there may be extenuating circumstances that you don't know about; you certainly don't want to risk physical injury or being charged with interfering with a police investigation when you didn't have anything to hide in the first place. However, do make it clear that you are not consenting to the search. Ask the officers for identification and an explanation as to why they are there and what they're looking for. Also, write down details of the search as soon as possible, in case you need them later. |

they couldn't use the information against you in court. And because they had no plans on going after you for anything they obviously didn't care. What town is this? Just curious what part of the country the police feel they can behave like that.

LOL. all this back and forth. it's easy, don't open the door. Just tell them to come back with a warrant. The second you open the door, they will find a way to come in. If they have no warrant, they cannot bust down your door. (i'm talking about this instance btw).

your average cop will push you around but if you complain the unit that is supposed to investigate the cops, you might get some results. no matter what they might of found they could never use any of it to charge you with anything but regardless don't just take it, complain.
