No 'double jeopardy' in Italian law. If she's truly innocent of the crime I feel bad for her.

I don't like 'double jeopardy', if new evidence comes out after a trial is over and it's compelling evidence then the accused should be tried again - if the objective of a legal system is to find the truth and punish the guilty for their crime.

I'm not sure if she is guilty or on.

I understand they do not have the double jeopardy law there in Italy, but at a certain point this woman can no longer be expected to defend herself in a court in a foreign country. She is a student, has been in prison for the past four or five years; How can someone be expected to defend themselves at this point? They put her in jail, had a trial, and lost; In the mean time she's been unable to have any income. Not really fair....

in america we have to prove beyond a reasonable doubt for criminal cases... beyond... this was not proved at all...

your not a lawyer because of your assumption there.. 3 people in a room 2 drugged up and 1 dead can spell a shit ton of different explanations that are reasonable and enough to put doubt that the 2 accused did it...

bunch of other reasons this is fucked up as well....

The main thing I remember about this was the trashy way our news media covered it from day one. All they did it seemed was show the girl and her boyfriend kissing and talked about how inappropriate it was and whether that "meant" anything or not. All it meant was they were kids who didn't really know any better. You could pick your ass and if it's caught on TV you'll have sick people on court TV shows and the like defining it as the action of a killer.

That's why I feel bad for her. No idea about 99.9% of the case. That's how badly it was covered.

I read a bunch of articles on it this morning, now I can't seem to find which one, but one of them was talking about the chance of extraditing, and said that the US would likely block it. They also said that if she traveled to a European country friendly to Italy, she'd pretty much be fucked. Someone in the comments of that article actually listed what countries she should avoid if she travelled abroad.

Even if found guilty, and Italy applied for extradition, the US are going to block it. She's looking at serving 20 years. They know that more than one person was involved, and her and the boyfriend are the only other suspects.

Because Knox is a US citizen, in the United States and therefore subject to the protection of double jeopardy, the US State Department would not honor any exradition requests from the Italian government.

This also means that any kind of international travel would be very dangerous for Know because the Italian government could issue a warrant for her arrest so if she landed in a country which might honor that warrant, she could be arrested and extradited to Italy.

As far as I am concerned, the Italians can go fuck themselves.
