Technically as long as you have:

ADV: in the beginning of the subject AND a valid remove link then no it isn't of course if you actually follow the rules 99% of all mail programs out there will filter it.

Spam is not illegal,

only US state i know that has a legal law is Washington State,


it just violate providers AUP, which gets you accounts termed, but you can sue spammers if you can catch them and got big bank,
