How CHOOPA stolen my money

1 week ago I bought Choopa server, they agree move my sites and configure all
When content was transfered they start configure server for smarttubepro
After 1 day they told me that can't configure because its not possible under centos6
I agree and they pre-installed to centos5.Another 1 day they trying setup all.No succcesfull
Next day software still not worked, I sent next tickets and they stopped answer.
In next 2 day I bought OVH server, hire admin from Poland and he did all in 1 hour....professsionals in Choopa its joke
Yesterday I requested to refund money because if they ignore me and dont want configure all then I want cancel service. They not answered.Today I sent ticket again with request to refund money. They answered me with new invoice for 12months service $5500 because I signed contract..I dont signed any contract but if in description was 12 month terms so there was moving and configure websites, they respect 12months contract but what about server migration ?

it was 2nd issue with Choopa, I give them 2nd chance and it was biiiig mistake

Few years ago I hosted with them many sites.Total daily traffic was about 150-180k
When I was in Holidays server was down over 1 week - HDD damaged or hacker attack,
Over 1 week sites was down and nobody fixed it!!! I lost traffic forever and thousands dollars...they offered me $100 compensation.....$100 I lost per hour and never rebuild all my network because lost all what was on server, trader list, content ,all
I hosted with few companies since 2002 and nobody cheat me like they.
Amerinoc, Isprime, Natnet - I hosted with them and they are fine, real professionals but Choopa its totally bottom

3. DURATION OF AGREEMENT AND CANCELLATION POLICY

3.1 The Initial Term shall begin upon confirmation of Your order or commencement of the Services to You and receipt of lawful funds. The term’s length is chosen by You and shall be indicated when You order Our Services. This Agreement may not be terminated by You during the Initial Term (and any renewals thereof) except in the event of a breach by Choopa. After the Initial Term, this Agreement shall automatically renew for successive terms, equal in length to the Initial Term, unless terminated or canceled by either party as provided herein.

3.2 You must provide sixty (60) days notice of non-renewal to Us should You not wish to renew this Agreement after the Initial Term. Choopa may terminate this Agreement at any time, without notice, in the event of nonpayment or violation of terms of service by You, if in Choopa’s sole judgment You have in any way breached this Agreement ("Termination for Cause"). If you cancel any Service prior to the expiration of any Term, You understand and agree that Choopa will not issue You any refund whatsoever, including but not limited to any remaining pre-paid Fees, set up Fees, and/or special programming Fees).

Fully confused, are you defending choopa or saying their terms are egregious?

The OP transferred his sites to choopa box, the box never worked. OP started tickets that went unanswered. OP then said fuck this, got a professional to do the work on another box in an hours time. OP wants his money back, choopa sent invoice for 5K+ in response... wtf is that?

Send choopa an invoice for 10K+ from an attorney for frustration.

icymelon 02-04-2013 10:22 PM

thanks for sharing your story. only reason you need customers to agree to a 12 month contract is if they dont want to stay. I'll keep that in mind when I need to add another host.

I can confirm Choopa harbour piracy sites, I can also confirm that their NOC has received many DMCA notices concerning customers of theirs who are involved with repeat infringement and that Choopa has totally failed to take action against such clients.

If anyone from Choopa wants to work with us to identify and terminate clients involved with repeat infringement then they should feel free to contact us.

That's interesting, because CHOOPA told us to start looking for other hosting after we received DMCA a few times.

A few times ?

One site we are currently tracking has been the subject of many hundreds and is still running with no sign of termination.

This outfit are hosting download links sites, file lockers and piracy blogs with no apparent concern for rights holders.

3 or 4 complains and they told us to start packing.

Was an expensive server too, about $1k/month

That's inconsistent with what we see with Choopa, perhaps you were unlucky.

Repeat offenders have no problem hosting at Choopa.

Examples:

UltraMegaBit.com
FileServe.com

Both blatant and infringing file locker websites with thousands of infringement reports filed against them.

Possibly how they spend more money on monthly basis which is why they tolerate them.

This complain was about the tech support only, not about what's hosted. Perhaps the OP wished to hosts illegal tube, complain about tech support would apply the same :)
