Can you have a paysite with unlicensed content?
 
Please don't :BangBang: or :321GFY or :ak47: or :feels-hot me for this question but I was asked this today and I didn't have an immediate answer to a question brought up in conversation today.

An old friend of mine has a collection of non-adult nostalgic cartoon's in a movie format. He currently has this online and he has a big bandwidth bill because of the many non-adult cartoon movies on his website. He asked me if he could turn his free site into a paysite in order to generate some sales to help offset the cost of his bandwidth bill.

Since he doesn't have the content licensed, I didn't know if he could do this or not. I'm leaning to "no" but I wanted to bring this question to you guys for input. His argument is that he wants to keep underage kids off his site since they are probably using up most of his bandwidth. He thinks that adults will pay to see the non-porno nostalgic cartoons. What should he do?

Thanks for the reply. Although it's nostalgic, he *does* have alot of recent stuff on there as well. Incidentally, he has WWF movie clips on there as well. Alot of them. He thinks the kids are viewing alot of his WWF movie clips too.

this is only my opinion but I don't think that he is allowed to do that... He can survive for a while until the content owner catchs him..

Also you can let him know the WWE/WWF is just like playboy when it comes to copyright infringment from what i've heard.

Also ask him if i steal his home if it will be ok that i rent rooms to make some money from having to keep the electricity and water on in his house. :1orglaugh

The way you word your question, it sounds like you (or your friend) think it's okay to use copyrighted material as long as the site is free. Where in the world did you (or your friend) get such a hare-brained idea? The question isn't one of profit, it's one of ownership and the privileges of ownership. In some ways, offering the stuff free is even worse, since other people considering pay to use it will then have to compete against someone who's putting it out free of charge. Not a fair competition situation at all. At any rate, fee vs. pay misses the entire point: If it belongs to someone, you or your friend need to get permission from that party (though I wonder if your "friend" is like the "friend" a doctor asks questions for, when all along he's asking for himself).

Sure you can. Don't listen to the haters, they just want less competition. These companies crave publicity so while they might not "officially" like it, they won't bother you. I'd consider using a bunch of Girls Gone Wild videos too, just give them a link so they won't have anything to complain about.

If you have to ask that question, you shouldn't be making websites.

What your friend is doing is the equivalent of ripping a DVD and selling it on your site. Or giving it away for free.
