websites that use embed vids from tube sites
 
If you have a site that has embedded videos from xvideos or xhamster. And some of those embedded videos are copyrighted, Are you libel as well as the tube site?

You probably wouldnt be libel, unless you wrote something about it.

You could, however, be liable for supporting copyright infringement.

Not unless you also upload the files to your server. Embedding videos is just code that calls their info with none of the videos being hosted by you..

I'm going to ask my lawyer now, not that I ever embed anything..

But lets say I'm promoting a big tube by making a 'fake tube' by embedding those videos or have a blog doing the same thing or embedding any other video from another site that allows embedding. When a copyrighted video that isn't supposed to be on the original site is DMCA'ed and taken down, it becomes unavailable for everyone that has it embedded too. How else would the sites with the embedded content know about it?
And if the video is knowingly stolen in the first place, the video should be reported and not wonder if you should embed that one or not...

why should it matter the origin of the file, who originally stole it doesn't matter

your actions as a webmaster are knowingly publishing a video on your site, it is not a random user publishing the video on your site, it doesn't matter that someone uploaded it somewhere else first and now you are publishing their upload, you are now choosing to put something directly on your site by your actions.... pretty hard to hide behind dmca for that :2 cents:

Ask Boneprone he got away with it because it they were embeded and not hosted on the serve, dont know why you would want to emebed other tube site movies anyway when you can buy cheap content for a tube

I would say it depends on whether you personally embedded that html into your site yourself or if you have a script that imports them.

On one of my tube sites I used to own. I would accept plugs for traffic trades and I got a take down request for a picture which the user used for his plug. I took it down and the owner of the pic was very polite about the whole thing, but if you are gonna allow tube embeds from other tubes then expect to get take down notices :2 cents:

Well using embeded videos is ok and fast to build up your tubes if you do not produce on your own.
