fair use still applies? if i use some getty images on a site..but also credit them and the photographer...that is ok?

according to gideongallery everything is fair use as long as you use the word "shift" and any random term...for example if I steal money out of a bank safe and call it "place shifting" then its perfectly legal and is fair use :1orglaugh

Look up fair use. Unless you're making fun of the photo or certain other specific instances, it's not fair use. Getty is a site where you can BUY an image for $10 or so. Just like webmasters, photographers need to get paid so they can eat, and the webmaster of getty needs to eat.

for some reason i thought giving them credit and listing them was ok

the more i think about it, surely it isnt ok.

The mainstream company I work for has a site we built just to show site proofs to clients, basically a list of clients with their work inside.

We placed an image of theirs in the header of a proof and put it up. It had the Getty (or Corbin, I forget) watermark on it, the problem was it was like a 300 dollar image and we wanted to make sure the client wanted to use that one before purchasing it. Getty contacted us threatening to sue one or two days later.

We explained what was going on and after some time they understood but had us remove the proof immediately.

I am curious how they found the image since it was a jpeg of the psd and not the orig pic that possibly had metadata or w/e in it.

Either way, lesson learned.

Woke up this morning with a mild case of food poisoning. Not even close to the top of my game and I misread the post. But still, if your business involves writing then you should be aware of copyright law.

that is one of the differences in having a wordpress blog for your site vs. a forum, at least with a forum you have the "user uploaded" excuse, with a blog, you are responsible for all the images you may put in your posts, and much more legally liable :2 cents:

Need to show that to a couple of people who couldn't understand why I wouldn't let them just pick images off google for their pages and made them select from a stock image site.
