Model names, who owns them?
 
I shot a model a few years ago, as it was her first shoot she didn't have a model name, so I made one up and basically forgot about her. Until late last year when comments started appearing on her page on Simonscans saying she was kinda well known under another name.

So I changed her name on my site to the one she's used on most other sites, and forgot about her all over again.

Only today I get an email from her today DEMANDING I stop using HER model name as she no longer does the kind of dildo based art I specialise in.

So at this point she's annoyed me - you do porn, you deal with it and don't whine and when you sign the bit that says you have no rights at all over how its used and under what name, then that's exactly what it means.

Or am I missing something here and I'm the meanie?

I own several domain names which are model names. Hell, I even own some domain names that are their real names. Either way, they can get fucked if they approach me like that. But, if they are polite about it, I may consider selling them the names.

As far as a model release goes, obviously you have a better understanding of it than she does. You are well within your right to use any name you want. If she has a problem with you using her stage name, offer to change it to her real name and see if she prefers that option.

As long as your release specifies that you can use any name you want to publish her under and assuming that you didn't change the name to her real name or another company's trademarked name, then there is nothing she can do other than badmouth you.

This is quite a interesting thread as I find myself in a similar situation...

I shot a model propably 3-4 years ago... like Simon said about his model, this model did not have a model name, so we created one for her... we bought a website with the same name... and launched a paysite for her.

In our opinion we created the models name, the persona and the website...

Now her new manager/agent as just contacted us demanding we give them the domain name... they are claiming we're denying her the opportunity to make money from her name... and in turn the domain name.

If you had been smarter at the time you should have done like Digital Playground does in the adult business or Vince McMahan does in the WWE and had the model sign an agreement where she agrees to take on the role of a "character" owned and trademarked by your company, which also owns the movies she appears in as well as the corresponding domains in exchange for a certain amount of work, a certain amount of monetary compensation & promotion. Then not only would she or her manager have no right to tell you not to use the name, but she herself would have no right to use it without you. I never bother with this because I am not in the solo site business. But if I was, it would be the only way I would proceed.
