Copyright question

Hey all.

So, if you own, for example, wowsex or wowporn, could you get in trouble for copyright? I know they have world of warcraft trademarked but could they do that with a word like wow that already means something else?

I have a wow domain that I am building. For now, i just threw up some posts/descriptions from N.A. just so something is up on it. They have great looking content and its designed so its kind of like the site is saying wow! porn! :1orglaugh.

It has had content on it for maybe a week and a half. No backlinks or anything yet, no seo and the name was recently reg'd. If I look in NA's stats for the past 15 days it has:
Raw Hits:628
Unique Hits:291

Google shows it gets 4400 exact searches per month.

Prob would be better if i play along and make a fantasy based site but I don't want to get into any trouble. There is a site I found that has like d&d type movies and pics, movies of chicks fighting and saving the day with only some light armor on lol (chain mail), etc... but I am nervous about making a move in that direction. :Oh crap

Could anyone please give their opinions on this?

:batmanThanks:batman

If it's "wow" look at those tits then you'r ok, If it WOW fighting teen sex warriors then you may have a problem.

Damn, that's what I thought lol. I have it looking like a "wow" look at those tits type of site now. The site I just found was this one http://www.baremaidens.com/

Thanks for the advice, I kind of assumed so but would have preferred that not be the case lol.
I'll just keep it on NA
:thumbsup

http://tess2.uspto.gov/ search 'wow'
These are the trademarks that are registered in the US. A name or term is not copyright a "work" is like a WOW Game is. A word (name or phrase) or image can be trademarked.

I've think wow or seven WoW would be ok so long as a) it's not a computer game and b) it's not clearly intended to trade off of World of Warcraft.

If the site looks a lot like world of warcraft or is a game, that would be a problem unless it's truly a parody or similar. Even in the case if parody, you can hope to win in court, but that implies you'll be in court. One lawyer said of trademark parody:

Engaging in trademark parody is a little like shooting at the king. Y had better be good at it, because if you attempt and fail, you are in big trouble. Parody is a defense to trademark infringement.1 The defense is tha there is no likelihood of confusion because the parody will not be taken seriously. While it must initially bring to mind the original, it must be clever enough to be clear that it is not the original nor connected with the original

Thanks everyone. I think this is a bit too hot for me to play with. It may have been a fun project but definitely not worth going to court over! I'm just gonna go with the original plan and put some like tonights gf or met-art type content in there and see how it goes.

I've seen people bitching on other forums about losing their wowgamegold.com etc domains.
