Sex Trafficking: It may not be what you think it is.

Another conviction under the forced labor statute involved a woman who admitted to a consensual relationship with the defendant involving bondage and sadism. The acts were photographed and placed on a website. She testified that she was coerced into continuing the relationship and that the defendant threatened to send photographs of her to her family and the media. Although the court found that the history of the statute did not address intimate relationships between two individuals, the legislative history did not expressly preclude criminal liability in these situations. Thus, the conviction was upheld. What does that tell you?
With that as a backdrop, consider Section 18 USC 1593A which was passed in 2008. The title of the statute is ―Benefitting Financially from Peonage, Slavery, and Trafficking in Persons.‖ The relatively short statute reads as follows:
Whoever knowingly benefits, financially or by receiving anything of value, from participation in a venture which has engaged in any act in violation of Section 1581(a), 1592, or 1595(a) [18 USC Section 1581(a), 1592, or 1595(a)], knowing or in reckless disregard of the fact that the venture has engaged in such violation, shall be fined under this title or imprisoned in the same manner as a completed violation of such section
