HELP!!!!! Bought content from a gfy member, and i'm getting sued for using it now!!!!

Ok, Here is the email i got this morning........

Mr. Vanderslice,

I have been retained by Clear Channel Communications, Inc. as outside counsel to resolve the matter regarding your infringing use of several photographs. In that regard, I am following up on a letter sent to you dated January 17, 2003 by Mr. Hamlet T. Newsom, Jr. Corporate Counsel for Clear Channel demanding that you remove infringing photographs from your website. As of this date, you have yet to comply. This is a final attempt to resolve this matter amicably prior to further legal action. Please contact me immediately at the number listed below.

That is the link that they are complaining about..........

I bought those pics along with alot of video from a guy on here right before christmas...... he wanted $75 for a bunch of pics and videos..............

Can't find the link now......

WHAT THE HELL SHOULD I DO???

vuacobac 01-31-2003 11:41 AM

i feel sorry for you man.

run run run before it's too late. go to Thailand to live with Kman.

vuacobac 01-31-2003 11:42 AM

just remove the shit from your site then. simple.

vuacobac 01-31-2003 11:42 AM

and do a chargeback

necoeds 01-31-2003 11:43 AM

I am going to remove it.

Deb 01-31-2003 11:43 AM

Well, the first thing I would do is take down that content. This will at least get them off of your back until you're able to sort it all out with whomever you bought it from. :2 cents:

Also, do you have the license for this content?

Probono 01-31-2003 11:43 AM

Unless you have the paper work to backup your license and want to hand it over to them so they get the real bad guy take it down and consider $75 a trivial loss.

Dveron 01-31-2003 11:43 AM

Err..why wouldn't you at least remove the pictures? Sounds like you alreadly ignored one warning. Take the shit down and you should avoid the suit.

jimmy3way 01-31-2003 11:44 AM

Clear Channel? Those guy have pockets that make Lensman look like a homeless crachead.

Run away!

It sounds as if you have been notified prior to this. If you do not have a license for the $75.00 worth of images take them down immediately. Mark it up as lesson learned.

necoeds 01-31-2003 11:48 AM

I do have the license....

directfiesta 01-31-2003 11:48 AM

Licence? Model release? contract?

If you do not have, remove and may that be a business lesson.

If you have, remove and supply the documents to the claimant so that he will go after the source.

PS: when it is so cheap to be true ....

escorpio 01-31-2003 11:53 AM

First, protect yourself take and that shit down NOW! Second, find your license and send a copy to the lawyer. If you don't have a license you have just learned a $75 lesson. If the lawyer tells you the license is BS find the fucker that sold you the content and get a lawyer and SUE HIS ASS! If you have no way of contacting your content provider you have just learned a $75 lesson. End of story.

JohnnyUtah 01-31-2003 11:54 AM

Did you buy that shit from that fucking scammer magicman?

TDF 01-31-2003 11:54 AM

just because you think you have a "license" doesnt mean its licensed..

freeadultcontent 01-31-2003 11:56 AM

What the hell? Ok umm sure. Did they claim they took the photos, or actually that the client that retained them did?

If that is the content on the link you gave, it is a public event, there is at least 90 people in the stands alone in pic 3. So I doubt you would need a model release or model contract.

I would still take the shit down until it is resolved. Yet unless they claim to have taken the pictures themselves, or that they controlled the entire venue I do not see how they could claim it.

KC 01-31-2003 11:58 AM

Has anyone told you to take them down yet? <g>

Take them down you dummy..

How much do you think it will cost to defend a copyright infringement lawsuit? It might run a little more than that $75!! :)

Don't think you're required to have model release for public nudity shots. Contract? Just curious, what contract do you need outside of a license when purchasing content?

Dude I'd totally take those down and move on....Send the license and work it out with them and make it go away. I'm sure you aren't the first one that someone sold their ganked pictures to. :(

Too many scammers out there these days.

Too true - it definately pays to purchase from the people who you know produce the content themselves or that have a very good reputation as a broker.

$75 for pics and vids sounds a little too good to be true.....

You should definatley send a copy of your transactions/communications and license to Clear Channel. Besides clearing your name maybe you'll be able to establish some future business with them - esp if you like their content.

aflex 01-31-2003 12:01 PM

Mr. Hamlet T. Newsom, Jr.

what a fucking pussy name to live with..

evildick 01-31-2003 12:02 PM

Have you tried contacting the guy you bought it from? Call the number listed on the license agreement.

And take it down!

Clearchannel will rape your ass good.

Dawgy 01-31-2003 12:03 PM

prolly one of the sluts work for them

For one thing man i would leave it alone,, fuck them
if it was serious they would of sent you a Certified Mail

Tell me if i sent you an email and said i was the president bush would you believe me? LOL

also man its public nudity content,, if i remember there are several laws about it saying it's legal,, ie girls gone wild videos

Rich 01-31-2003 12:13 PM

Didn't you start your site using stolen content? Maybe that's your problem, what used to be at that url? You're get no sympathy from me, play with fire...

necoeds 01-31-2003 12:14 PM

They did send me a certified letter.
Problem is, that they sent it to my old address (which they found with whois)

My lawyer told me to remove the photos immediately, and for $500 he'd take care of it, so that i would be able to use the pics again.

I really don't even care about the pics, as i never put them in my member's section. I only used them for tgp advertising.

I am just pissed off.

Comply. Remove the content and write of the $$$ and time you lost. And then promise yourself that you will NEVER, EVER, buy content from anyone other than a reputable content producer/distributor again.

Buying from some guy who posted on GFY, are you nuts?!?

Sorry, I sympathise (a tiny bit) with your situation, but content-buying is the most dangerous thing we all do. You have to have your shit together in this regard. The only difference between being a child pornographer (the kiss of death) and a legal internet pornographer (the job from heaven) is just ONE picture taken/sold by some guy who was either a crook/creep or did not have his shit together.

NEVER, NEVER, NEVER, NEVER, NEVER, NEVER, NEVER, NEVER, NEVER, NEVER, NEVER buy content from someone you don't trust with your life.

.:Frog:. 01-31-2003 12:20 PM

I'd remove the content, then tell Clear Channel someone is selling their content.

thepornoguy 01-31-2003 12:28 PM

I will make you some content! Exclusive Content for your use only.

Clear Channel does college events and of course the shoot images of their events.l

I would take it down and be glad it only cost you $75

[email protected]

ToolGuy 01-31-2003 01:40 PM

Just curious if this is the content you bought...

Ok, here's the deal.

The guy that sold it to me (I will not divulge which post it was that i purchased it from) Has refunded me.

No harm done.

Here an email that the lawyer just sent me:
------------------------------------------------------------------------------

Mr. Vanderslice,
This email is sent to confirm that the infringing photographs are no longer on your website. As long as this holds true, I will consider this matter closed. Thank you for your prompt attention to this matter.

He scammed you and others and just becuase he refunds your money you won't let other webmasters who now are potentially infringing copyrights know who it is? Thats bullshit.

NastyJack 01-31-2003 02:10 PM

The first thing you've got to do is remove those images/movies from you're site and find the treand that you where just mentioning and e-mail it to the lawyer who wrote you.

He clearly mentioned that this is in fact a warning - so just remove the shit from you're site and give him a call.

Next, be sure to tell us who sold you those pic/movies so we can have a little fun with him to.
And finally, download www.kazaa.com and get those pic/movies on every computer that will swallow them.

Regards
NastyJack

sternyduke 01-31-2003 02:10 PM

at least give us a heads up on who sold you the content...

detoxed 01-31-2003 02:11 PM

No harm done? Everyone else that bought the content was harmed. You are putting people in the position to be sued and lose their money for the content. Its irresponsible NOT to say who you bought it from and what thread it was from. Sounds like that guy gave you a "refund" to shut you up.

necoeds 01-31-2003 02:12 PM

Deal is that He took the photos and videos..... clear channel never said other wise.....

Problem arrose because they are claiming that they didn't allow any cameras to get in, and therefore, the camera must have been hidden. Which is clearly not the case. However, I'm not about to fight it.

After speaking at length to my lawyer, public nudity content is shakey ground period...... and i'm not about to take on a "big dog" to prove a point.

The guy that sold it to me didn't screw me. If i posted who it is, then everybody would want a refund, which is most likely not neccissary.

I do alot of advertising with our local clear channel radio station (the blaze) and I have a feeling that is the reason that I was targeted.

Jim

stevo 01-31-2003 02:15 PM

Thats pretty gay, just because it was a Clear Channel radio show get together they think they own the copyright to all the images taken at the event? Then why allow cameras? If you fight it you'd probably win, probably not worth the time though...

Paul Markham 01-31-2003 02:15 PM

Here is some advice from someone who might have the answer.

First if he's selling it for an unbelievable price ask yourself is it too good to be true? Odds are it is a bummer.

Secondly are you buying it from someone with a reputation to protect, or some annon fucker who will appear under a different name in two weeks?

Thirdly, will you get all the 2257 and 2258 documentation, you are legally required under law to hold it. See my front page at the bottom for those who do not know the law.

Besides it protects you in so many other ways. Like, is the girl of the right age, did she agree to be shot and sold, is there a model release in her native language and English. Was it shot by the guy you are buying it from or an agent/broker/reseller?

For $75 and some hassle you learnt a lesson that would have cost $1,000 at a seminar.

Bet you won't be so eager to look only at the price in future?
