HELP!!!!! Bought content from a gfy member, and i'm getting sued for using it now!!!!
Ok, Here is the email i got this morning........
Mr. Vanderslice, I have been retained by Clear Channel Communications, Inc. as outside counsel to resolve the matter regarding your infringing use of several photographs. In that regard, I am following up on a letter sent to you dated January 17, 2003 by Mr. Hamlet T. Newsom, Jr. Corporate Counsel for Clear Channel demanding that you remove infringing photographs from your website. As of this date, you have yet to comply. This is a final attempt to resolve this matter amicably prior to further legal action. Well, the first thing I would do is take down that content. This will at least get them off of your back until you're able to sort it all out with whomever you bought it from. :2 cents:

Unless you have the paper work to backup your license and want to hand it over to them so they get the real bad guy take it down and consider $75 a trivial loss.

First, protect yourself take and that shit down NOW! Second, find your license and send a copy to the lawyer. If you don't have a license you have just learned a $75 lesson. If the lawyer tells you the license is BS find the fucker that sold you the content and get a lawyer and SUE HIS ASS! If you have no way of contacting your content provider you have just learned a $75 lesson. End of story.

What the hell? Ok umm sure. Did they claim they took the photos, or actually that the client that retained them did?
If that is the content on the link you gave, it is a public event, there is at least 90 people in the stands alone in pic 3. So I doubt you would need a model release or model contract. I would still take the shit down until it is resolved. Yet unless they claim to have taken the pictures themselves, or that they controlled the entire venue I do not see how they could claim it. |

They did send me a certified letter.
Problem is, that they sent it to my old address (which they found with whois) My lawyer told me to remove the photos immediately, and for $500 he'd take care of it, so that i would be able to use the pics again. I really don't even care about the pics, as i never put them in my member's section. I only used them for tgp advertising. I am just pissed off. |

The guy that sold it to me (I will not divulge which post it was that i purchased it from) Has refunded me. No harm done. No harm done? Everyone else that bought the content was harmed. You are putting people in the position to be sued and lose their money for the content. Its irresponsible NOT to say who you bought it from and what thread it was from. Sounds like that guy gave you a "refund" to shut you up.

Problem arrose because they are claiming that they didn't allow any cameras to get in, and therefore, the camera must have been hidden. Which is clearly not the case. However, I'm not about to fight it. After speaking at length to my lawyer, public nudity content is shakey ground period...... and i'm not about to take on a "big dog" to prove a point. The guy that sold it to me didn't screw me. If i posted who it is, then everybody would want a refund, which is most likely not neccissary. I do alot of advertising with our local clear channel radio station (the blaze) and I have a feeling that is the reason that I was targeted. Jim |
Thats pretty gay, just because it was a Clear Channel radio show get together they think they own the copyright to all the images taken at the event? Then why allow cameras? If you fight it you'd probably win, probably not worth the time though...

Here is some advice from someone who might have the answer.
First if he's selling it for an unbelievable price ask yourself is it too good to be true? Odds are it is a bummer. Secondly are you buying it from someone with a reputation to protect, or some annon fucker who will appear under a different name in two weeks? Thirdly, will you get all the 2257 and 2258 documentation, you are legally required under law to hold it. See my front page at the bottom for those who do not know the law. Besides it protects you in so many other ways. Like, is the girl of the right age, did she agree to be shot and sold, is there a model release in her native language and English. Was it shot by the guy you are buying it from or an agent/broker/reseller? For $75 and some hassle you learnt a lesson that would have cost $1,000 at a seminar. Bet you won't be so eager to look only at the price in future? |
