Gideon asked me to post this...

Music Fan Owes $675,000 for Illegal Downloads, Court Rules

So the guy gets his case reduced by 90% down to $67,500 and decided to appeal the verdict, so then the court hears the appeal and not only doesn't rule in his favor but they adjust the fine back up to the original amount it should have been. Someone didn't think that through, they should have stopped while he was only 67K down.

JOEL TENENBAUM: "This is obviously more absurd than it was before."

I guess stealing music and then sharing it with thousands of other people isn't absurd.

WTF " In his appeal, Tenenbaum argued that the US Copyright Act is unconstitutional and that Congress did not intend the law to impose liability or damages when the copyright infringements amount to "consumer copying".

He also said Sony was not entitled to monetary damages without a showing of actual harm, and he claimed there was no harm by his downloading and sharing of songs. "

This is bull shit. He simply time shifted the music and is not legally responsible for his actions. The judge has no idea what he is talking about and they are interpreting the law incorrectly.

So the idiot kept babbling this "sharing" nonsense even in the courtroom, in front of a judge? Unbelievable.

OTOH, now that he's been ordered to "share" $600K with Sony, he has a chance to prove that he stands by his words. Sharing is caring dude. You bet Sony execs will be happy with your "contribution", will post a lot of "thank you"s and give Karma to you.

he should be suing sony for helping them increase their sales by introducing new customers to sony's artists...

sony owes this guy money..

I'm against stealing music or whatever, but imposing ridiculous fines on potential customers is not the route to go. I think the ISP should be required to impose a penalty of something like 3 months without internet access. Ruining someone's life is not the answer, especially when there's millions of others getting away with it.

Good point.

Ever wondered why you pay Nike to wear their shirts? Shouldn't they give them away for free, since their brand is across your chest? Not being sarcastic, just wondering what you think.

I don't pay for that shit. I go to Manila where they make some of it, walk right into the factory, where all the little kids are making it, and just walk out with it.

Figure I already own some Nike shirts and shoes, so I just replace the old ones with new ones because they have better material and are lighter.

It doesn't hurt Nike or the kids.

"28-year-old graduate student pursuing a physics PhD at Boston University" ... so the guy isn't stupid. Fuck him. I hope he has to pay for the rest of his life.

There should have been a Best New Tag category in the GFY awards.

The </Gideon> would have won hands down.
