If The Government Really Wanted To Regulate Porn...

... couldn't they just as easily mandate a "xxx" sub-domain be used for porn?

for example: xxx.yourpornsite.com or xxx.yourpornsite.net, etc...

I doubt the govt will mandate .XXX soon, but if they really wanted to, couldn't they simply mandate adult content be compartmentalized within a sub-domain?

This would accomplish the same results, and it would even have more flexibility. You could use the main site for non-nude tours and promotions, but all of the "adults-only" content would have to be located within the designated sub-domain.

What do you think?

If government wanted to regulate porn they would make us use xxx domains.

We are one step close to that now.

UNITED STATES V. PLAYBOY ENTERTAINMENTGROUP, INC. (98-1682) 529 U.S. 803 (2000)
http://www.law.cornell.edu/supct/html/98-1682.ZS.html

Held: Because the Government failed to prove §505 is the least restrictive means for addressing a real problem, the District Court did not err in holding the statute violative of the First Amendment. Pp. 6?23.

This ^^^ see above ... revolves around the right to place Time, Place, and Manner Restrictions upon speech. Porn publication is a form of "speech."

This is US Law of course ...

If The Government Really Wanted To Regulate Porn...

It doesn't, it wants to look like it's doing something.

There are many ways they can bring regulation to online porn, they haven't the will.

All the gov has to do in order to get rid of us, is to get out of our way. We'll destroy ourselves.

No, what will be left is free porn. Tubes that will survive by selling ad space to dating a cam sites.

If porn comes off the Internet is will be the biggest boost for the porn industry ever, the earnings will be colossal. Profits will be great. And the opportunities endless.

I guess that means we are one step closer to not being allowed to produce hardcore porn.... Being that some of it is already illegal. Or maybe they will force a rating system to use so all blocker software would work.... Or warning pages could become law. Heck maybe all sites, free and pay will have to verify age like in Germany.

With so many options, better ones at that... .xxx stands no chance of being forced.

Look at the UK and their BBFC for an example of what could be done.

License all porn sites. No license, no argument you're breaking US law so unless you yourself block US access. The US will do it for you. No billing, no advertising, Domains deleted and blocked.

All sites will be subject to producing documents that comply with US law 2257.

To get a license cost what it costs to run and enforce the licensing system. License cost will relate to the size of the site and the sites will be reviewed.

Some companies like Manwin would lap it up and join right away, along with all the other big guys. Because everyone who can't afford or get a license, loses the traffic. Also free porn becomes a thing of the past, affiliates won't be able to afford the costs.

And they can add what ever other stipulation to getting a license they wish to.

The German law is a joke, Germans surf sites in other countries.

Exactly.... So many options, already tested and in place, all over the world.

If a state here tried to force it, it would go before the supreme court, which has already said porn is protected under free speech. Limiting that free speech has already been tested.....and lost, which .xxx would do the minute filtering was added. Then we have the copy and trademark issues, which would bind this up in the courts for decades.

More reasons why .xxx will never be forced.

We have a much bigger chance of being forced into a rating system, like movies and music use. Something that is already in place, used widely, and accepted by the public.

MaDalton 07-07-2011 02:14 PM

i like the system in germany - no free porn available on .de domains - no tube sites - no message boards full of stolen content.

and those who know how to work with it still make a lot of money, i can tell cause they are my clients.

The method I proposed doesn't have to fall foul of the Free Speech protections. It makes websites publishing in the US subject to US laws, existing laws.
