Porn Illegal on AU domains ?
I was checking out
www.freeones.com.au it appears to be owned by Freeones and has the text "Sorry but porn is illegal on a Australian domain" I am not sure this is right, my legal advice is that you cannot host porn in Australia but porn on .com.au hosted outside Australia is fine. My old Paysite teenager.com.au was the first to receive a takedown notice when the content regulations came in, I just moved the site to Webair at the time in 2000 and kept running, it was featured on 4 Corners (a public affairs program on Aussie tv) as an indictment of the uselessness of the regulations. What do other Aussie webmasters think ? |
Maybe it's a good idea to err on the side of caution..

Didn't they pass legislation to check any hard drives in your possession for porn. At the airport. I got hastled by customs there before. Never again.

They've already expressed strong concern on blocking .XXX when it goes live.
Australia is a big European country that consumes alot of porn. Filtering .XXX for that entire nation would make the most sense, since its a porno only domain. |
Too much hassle and risk for the rewards imo unless you want to hire a lawyer to go over the fineprint, even freeones could be challenged for the domain since they arent registered to trade in australia.

Freeones are fine with their .com.au domain, they have a trademark which is a legitimate basis for registration, I was just surprised by what they have on it.

I've got several .com.au domains associated with porn - all owned by legally registered businesses with corresponding business names and the websites are hosted in the US, all perfectly legal. They really help when it comes to being higher placed on Australian search engines.
It is an offence to produce unclassifiable content material such as porn movies and photos. All videos etc here have to be classified as G, PG, M, MA or R18+ - if it can't fit into one of those categories then you're breaking the law. They took Abby Winters on and drove them off-shore - however I do wonder how the Aussie camgirls on MFC and the like get away with it. Some of them produce porn vids etc and sell sex shows thru their websites and skype - maybe I should be buying content and overdubbing Aussie accents into the audio! Hmmmm! :GFYBand |
