The lupe threads got me thinking about this......

Ok first of all, forget about US laws. And let's say the country you are shooting in has a legal age for consent at 16 or lower I don't know what all countries ages are etc.

You get contacted by a model who is 17, so not old enough to have adult/nude content shot of her to be used/published.

Now forget about the selling/distributing of content.

What if you done an audition with a 17 year old to try her out. Shot it, but didn't use a release or anything and didn't sell/distribute it.

Would this be seen as a private video? like homemade for personal use and be legal? If no cash changed hands ofcourse.

Or what?

Then when she turn 18 you hire her, get her to sign a release, pay her and do what you want with the content.

Say these videos were shot, and someone got hands on them and uploaded them to a tube or whatever. What would happen?

Just wondering what people think about that. Not saying that's what happened or anything obviously because clearly it doesn't look that way. Just a wondering thought.

Unless there is something like a tattoo that wasn't there in the 17 videos and she definitely got on her 18th birthday how is someone going to decide which videos were illegal?

Good point.

With photos you would have the exif data, but that can be changed and removed. so no real way of knowing there.

Video there isn't really any way of knowing as far as I know.

As a photographer who has shot nudes for more than 40 years in Europe and the USA i would say absolutely don't shoot any model male or female unless they are 18. Once the images or video are on the web they are seen by every country, even if you shot the stuff in a country that allows nude modeling at 16 don't do it, its not worth the prison time and there are thousands of models out there who want to shoot that are of age so why take the risk ? And like Lords they could turn around and rat you out. Just my opinion is all :helpme

Considering your a company or business and youre an older gentleman and she's a minor, you'd have a hard time convincing anybody that it's anything other than audition and business related and that you plan on eventually using it. If she had an issue with you, she could screw you over also. If there is evidence of an audition and she simply claimed you paid her. That's all it'd take.

I could keep going, you leave yourself open to get screwed. Sometimes it's not worth the hassle. Even if you find a loophole like not paying her, etc. etc

Will have to look that story up, the name sounds familiar. I don't shoot anyone under 18 anyway. Even clothed/portraits and stock images I use 18+ models.

Was just thinking about the whole thing going on with Lupe from LL/ILL (can't remember her real name) and her ex. And was wondering where what I mentioned above would fall.

Say they shot some stuff with a few girls who were legal age, but didn't sell/distibute them. Obviously he/they/somebody did and fucked up. But like if it was her hubbys hobby or something for his personal enjoyment. She found some girls for him and shot it, then he decided to sell it or something along them lines.

Not sure, but I am and I wouldn't be messing around with anything under 18... plus I like my women to have curves.

not sure what the laws are in other countries but in canada the consent law is 16, this usually shocks people but the reality up until 5 or 6 years ago it was 14... However, there are laws in canada that make it absolutely illegal to film anyone under the age of 18 here, whether its consensual or not. I would bet that most countries have the same law for that same age.

I did a project on pornography and law in school well before i was in the industry... hehe
