Here comes the business decision.

Is it cheaper to buy .XXX domains to protect your brand/trademark, or to sue people who infringe on your trademark?

I have no plans to buy any, but if I did it would only be to protect my top money making sites. It wouldn't be a free for all like I've done with .com. Though, nothing is set in stone. Just trying to look at it from a business point of view.

not likely. $60 wholesale means near $100 retail. that is 10 to 1 or worse against .com domains. not a very wise investment decision.

At some point in the very near future, we won't have a choice. And by then it could be too late as some "domainer" has probably already registered your brands name.

This industry just got a whole lot harder for us small guys............

There is a lot more to making .xxx mandatory than just a couple of people on an board deciding it.

In the US it would have be proposed as a bill and make its way through the house and senate the signed by the president. While it would be easy to say that could happen in a heartbeat we have to remember that many conservative groups were very much against the .xxx because they feel it legitimizes the adult industry. They don't want us to have our own TLD and be legit, they want us put out of business. So chances are they aren't going to be in a hurry to tell us we can do business as usual so long as we stay on a .xxx.

But assume that it does make it through and gets signed into law, it would be immediately challenged and end up in court. A few years back during the COPA days the supreme court ruled against a law that would require sites to verify age because they said that there were adequate filter options out there for those who wanted to block adult content from their homes. Those filtering options have only gotten better in the last few years and now there are even plenty of free options. I can't see the supreme court then deciding that those filters are now not good enough and that all adult sites must now be a .xxx especially when you realize that only about half of the adult sites out there are owned/operated by people in the US so webmasters outside the country will not care nor bother with it.

This is just a money grab that after years of work and millions of dollars spent has actually worked.

Anything could happen. I never say never. But the odds of this ending up as a mandatory use item are very, very low and most likely years away.

Definitely not unless it is the same price as other regular domains. It's bullshit that apparently the current charges are $75 when the average domain cost is around $10. Why should I pay more? Plus you know many governments will try to target it for further tax increases and regulation later on.

1. I won't buy any.
2. Add safesurf metatags (or similar tags that identify your sites as adult) to your sites/pages. That way parents that want to block access to adult content for their children can block it using netnanny type programs (those programs read those metatags).
The important thing now is to make it clear that there is no need to make .xxx mandatory in an attempt to make filtering easier for parents: (1) Parents who want to block access to adult content can already do so. (2) The adult industry voluntarily makes it easier for parents to block their sites by including extra identifiers such as icra or safesurf tags.

How many domains do most people have trademarked? less than .005% ? Unless you are a big program with unique names/brands most people do not have their domains trademarked.

All of those people who buy and sell (hoard) domains and try to sell them for ridiculous prices would have gotten in on this and reserved the domains years ago.

Has ICM mentioned if they are going to be auctioning off better names? Names like FreeSex etc. that are generic, not trademarked, I highly highly doubt they going to let someone register that for regular registration cost, just to have that person turn around and flip up for a lot more money.

The fact of the matter is, in the majority of the cases you wont be able to register a .xxx domain even if you wanted to, unless if the domain was very shitty or had a trademark.

so what? just let them sit on their overpriced domains... Just because a domain ends in .xxx doesn't mean it will suddenly start getting SE traffic or massive amounts of typeins.... looks at .mobi, .co, .name,...

They did mention that they might hold on to generic names such as porn.xxx etc and point them to a directory and then list the .xxx domains registered.

I guess this would be to tempt buyers with the promise of a free listing /traffic.

from what i've read all you have to do is own the .com and you get first swing at the .xxx. not sure if they will charge reg fee or what though.

i won't be buying any. they are too expensive just for a 'what if' senario. if i owned a million dollar .com domain, i would probably get the .xxx (as long what i read was correct, that the .com owners get the .xxx without any auction) but the domains i own just aren't worth it. while im not worried about xxx this just gives more reason to get out of this shitty constantly raped industry and i'm glad i invested the majority of my money into mainstream domains and not adult.

.com is king. always will be. xxx is just another cc, co, mobi, bullshit. Anything anyone can do with your com domain they could have done with any other extention. xxx is just a money grab. The gov is not going to go near it or legitimize it at all. It's just going to hang out there and get filled up with malware pages and drive bys. Of course, this is just my opinion. I sure won't be using it.

No way its going to happen like that. I doubt the 200K+ or whatever domains registrations they claim to have are all people with the .com trying to get the .xxx equivalent. I also see no way in hell the guy who owns "cams", "webcams" "free" "sex" etc will be offered the .xxx at normal registration cost (unless they did a shaddy deal with them for support). We will see how it plays out, but ICM could auction those domains off for 1000x more the registration fees and they are too greedy to pass up an opportunity like that.
