if ever there were a death penalty case this should be it...straight up premeditated execution.

kane 12-08-2017 03:16 PM

In case anyone is curious, the cop was put on trial for 2nd Degree Murder and found not guilty. It's a shame. That is a straight up execution.

Sly 12-08-2017 03:50 PM

I'm not familiar with the case. He was obviously scared shitless. Those instructions were extremely specific, which non-stressed out people with no guns pointed at them would screw up more often than not.

What happened? Who was he?

My understanding is that the guy was from Texas and in Arizona for a short time working. He was a pest control/exterminator. Apparently, he had a few people over to his hotel room, they were drinking, and the guy showed his friends a couple of pellet guns he uses for rats etc on the job. Someone saw the guy with the air rifle and called the front desk and they called the police. When the police arrived, they called him out of the room and the video takes it from there.

During the trial, he said he was afraid the guy was reaching for a gun. He was unarmed and the defense said the guy was trying to pull his shorts up. The shooter is no longer a cop, but he was found not guilty of murder.

Well, if you got up off your ass and started a riot then maybe you would get some.

Instead of dying like a bunch of pussies and being afraid; try fighting for your rights like Black people do.

Just pretend that your hokey team lost. You know, something you really care about.
Do that instead of spending all day on GFY making dead Trayvon jokes.

No shit.

The cop was too busy masturbating over his authority to just put handcuffs on the guy
while he laid down and complied.

My guess is that he was trying to pull his pants up. However, when a police officer tells you to crawl and instead you put your hand up to your back to the waistband where someone who have a handgun, well....

Here is a screen shot. The arrow points to his arm. He was told to crawl, and it's very easy to see how a police officer would think he was reaching for a firearm...

The guy was most likely drinking and paying attention to police orders wasn't too high on his list of priorities at that exact moment.

I always thought the rules of deadly force dictate that it's only to be used against an equally lethal show of force. Was there a gun visible and pointed at anyone? No.

Cops are paid to be in harm's way and they can't shoot citizens because they think their life may be in danger in the next few seconds. This is another example of a cop, barking like a scared dog and then taking a life -- which inevitably was going to happen anyway, whether it was this guy or someone else. It was his destiny to shoot someone dead once he was given his authority as a police officer. He sounds like a high strung wreck of a man scared of his own shadow and shouldn't be in situations where can shoot a citizen with an AR15.

The cop's screaming escalated the whole thing and made a guy who was already drunk now terrified. The article I read about it said the expert that testified said he could see how it looked at the moment like the guy was reaching for a gun, but he also said that there were plenty of times they officers could have approached the guy and handcuffed him but they decided to have him crawl to them and everything went bad.

My initial thought was "why not go to them?"

After thinking it over, the only conclusion I came up with was that the officers thought someone was still in the room. In that scenario, yes, it makes sense to have the person crawl to the officers.

The guy was clearly absolutely terrified. He did not have an ounce of threat in him. Regardless of what protocol was or wasn't, those officers should have recognized the emotions at play in this scenario and adjusted their tactic.

Terrible tragedy. I can't think of any possible way how anyone could defend this officer. There are always other options. If he was not trained in those other options, he should not have been running around with the authority to take someone's life.

In many countries this would have been handled even without cops taking out their guns out of the holster at all. And in this case it was like 100.00% safe to just arrest this dude at ANY point. I mean it was clear from the first second that he was scared shitless and that he won't resist or let alone attack cops.

I watched it hours ago. Five shots?? One done right would have disabled him. Yelling didn?t help the situation if the guy was drunk. ?Not guilty? was a shock and I hope they interviewed jurors to see how it was justified. He may have feared for his life but excessive force wasn?t necessary. They never said if the woman was arrested and if so, what charge?

There was not a firearm, but the police officer did not know that. In fact, the police officer was responding to a report of a firearm so it is understandable that a police officer feared a weapon was present, and it's understandable that the officer thought he would be reaching for a firearm.

Police officers are paid to be in harms way, but they also have the right to protect themselves.

I believe the proper thing for the officers involved to do would be to use non lethal weapons, such as a shot gun that shoots bean bags. This would have protected the officer, and also the victim.

.

Yes, That is true. But I used to listen to police calls on my scanner. In El Paso, I remember people prank calling and reporting guns at bars and strip clubs all the time. Kids are now swatting each other all the time. Could you imagine that guy screaming and cussing at a room full of drunks?, Somebody is gonna get smart or drop something. He shoots one person, everybody starts moving. It is gonna be a blood bath. Glad he is off the streets.

I don't know, I guess that would be a good, fast way to go. Plus your family would probably get a good settlement. I just hope I wouldn't be crying and crawling on tape.

The thing is, his gun was never allowed to be entered into evidence. The judge didn't allow it because he thought it would be "too prejudicial" so the jury never saw it and knew nothing about it. I have a feeling if they had they may have felt a little differently.

One thing that is clear is that the officer in question wasn't handling the stress of the situation very well. He was not a hardened professional giving stern orders, he was screeching like a hysterical old woman. To be in command, one must be cool and collected, and this guy was neither of those. The officer had trouble handling himself and was breaking and cracking under stress, and that made everything far worse. One can be stern, forceful, commanding, all without being a SCREAMING HARPIE. This type of tone and loss of control only makes the situation worse, the more upset the person calling the shots gets, the morel likely the other person is to start panicking, and two panicky people make for devolving situations. The more fucked up the cop got and screamed, the more the suspect got scared and fucked up, the more the suspect fucked up the more the cop got stressed and cracked, ect. The man in charge has to be the man. The man in charge was a panicky man who could barely manage himself, much less a suspect, and an entire situation. For fucks' sakes, the kid was screaming at his fellow officers. He was in poor mental status.

Old fashioned discipline is very important for these things, old discipline wasn't just for soldiers to follow commands and march in form, it was to keep men from cracking under combat and holding line while getting shot at, or facing cavalry charges, ect. Keeping a cool head. If you don't train that, you are missing out on a major part of training anyone in combat. Beyond that, not all men are created equal, and even with good training some men will crack and break under stress. There is no replacement for solid men under fire in units, who set an example and lead the way. It also gives the younger guys something to learn from in example. Beyond the brownie points for promotion are the men who are naturally in tune with combat and have the solid leadership capability to stay cool. Having scared rookies in situations like this puts everyone in danger.

This is a police officer taking someone into custody who they believe in armed. When police believe you are armed and you reach into your waistband.... What would you expect to happen?

I got pulled over in TX once. Cop asked if I had any guns, Said 3 in the trunk.

He called back-up and had me get out the car and walk around to the side of the car. Get on my knees with my hands up. He threw over some cuffs and had me cuff myself behind my back.

That was pretty simple. None of that crawling stuff.

As I stated previously, you can't shoot someone because you think a gun many be produced momentarily. He's fearful with an itchy trigger finger and is a boy doing man's job. There's a guy laying in the hallway on his belly and the cop's covered in body armor holing an AR15. He's a scared little bitch.

Bottom line....cops can't be shooting people when they don't see a gun.
