we need a posse to make it happen.

http://uspto.gov is the place to learn all about filing patents. http://www.uspto.gov/web/offices/ac/...8october02.htm has the fees

subset/superset is kind of a non-relevant question ... its not exactly xml nor html ... but it can be anything ... in normal html it will be simple tags .. in complex applications it will be more complex xml akin to normal xml ... not really locked in to anything
