Read the emails above, we asked that things be removed from cliphunter as it was stolen material. Not unlike anyone else.

Your guy emails back telling me how it works, or rather, how he sees it. More or less, trying to justify the theft of content. We had no interest in suing anyone, but it's a DMCA, when you don't remove the content as you're asked, don't you expect the company to say hey, we're going to look at legal options or contacting your host or whatever if you don't remove our content? It was never a threat, it was if you don't remove our content, we'll look at other options to have it removed, that wasn't a threat, that was how DMCA's work. If the site doesn't remove, you take action.

We NEVER had issue with Pichunter. We had issue with Cliphunter. We asked that our things be removed, your guy started in about Pichunter, why? Not sure exactly, we never had issues with them or the affiliates using PicHunter.

Your guy made this about Pichunter and the affiliates. Your guy said you'd decide to remove images from Pichunter. This all stemmed because you had our stolen videos on cliphunter and your guy wanted to explain that I had to allow this and adapt, this is how it works etc.

I disagreed and he then said fine, we're dropping you from PH.

it's clear you're trying to hurt our program, which is fine and well. Affiliates that promote us are doing great. Pichunter is still fine by us, again, it was only after YOUR GUY said you were removing our content that we said great, remove our content.

Cliphunter though, is still not allowed to steal our content.

Not sure why this became GFY drama but perhaps that's how you run your company.

Pic Hunter and Clip Hunter are the same database from the krawl newtork.

Pichunter galleries appear on cliphunter, cliphunter streams appear on pichunter. The sites are the same database, with different designs.

We've had issue with other people over their "brand" terms. ATK, Anilos, and others have been fairly silly regarding their "terms" of content usage. Usually the issue is over the restriction of "thumbnails" of their content on pages that do not link to them exclusively. Such as on a category page, or search. We have removed their content until they issue specific licenses or exceptions to us in writing. If you take your content rights that seriously, we can't afford to display a "thumbnail" or "cache" any of your images when you get ridiculous with take down notices that are demanded without respect to reason.

Complaints are processed as a matter of routine. Threats to sue, references to imminent legal action and furthermore are presented to the legal team immediately, and our response to the incident is escalated.

In this case, we were advised to remove all of your images as soon as possible to prevent further potential liability. We're not sure which submitters are or are not following your terms exactly, so we must prohibit them from exposing us to further liability indirectly.

Actually I @Replied you days ago asking for an ICQ, or other IM service contact so we could have a conversation, rather than a series of "statements" via e-mail. My request went without response. Also, e-mail only support is fairly shitty, but whatever.

At no point did we steal your content. Click the unhappy face on any page of cliphunter, and report content as "copyright infringement". And it would be automatically removed within 10 minutes. Furthermore, at no point were anything other than thumbnails stored on pichunter or cliphunter servers. They are search based displays of other sites that have material. If they remove, we do not have a copy. Your issue is with them, or the user that uploaded to them, not us.

At anypoint when people threaten legal action, we are cautious. RK, Brazzers, Adult Friend Finder, and others have been embattled in court actions recently. Courtrooms are costly and hinder progress, we avoid them at all costs.

Removing content is something we did for you immediately on first contact, and do routinely without verification or legal DMCA request for users and companies routinely, along with auto removal tools on the public site. You however threatened to "Show us how" whatever you were. So, we continued removal to make you happier.

So, we're notifying our submitters of a change of Rules, and informing them why we are disabling their galleries so that they don't think that we are mad at them. It is not uncommon for our company to make announcements on this board regarding changes to our rules.

phTorrents - A great deal of the content there is actually licensed under special promotional agreements with those companies. We have no outstanding DMCA complaints against that site, and have had only 5 ever.

That's because we try our very hardest not to be assholes. There are some conventions and standards that are certainly being debated on a global scale regarding Copyright and how to handle it. I have never advocated the "tube" style of doing things. However, it does appear to be the winning format. You can't just keep releasing Beta Porn in a VHS/DVD/Blu-Ray world.

Ask around, we've always been easy to work with, we didn't start the "tube" game. In fact, we lost an absurd amount of market share to RedTube, YouPorn, and PornHub when we made the decision to close Gexo.com in 2008 when it was very competitive with those. That decision has cost our company millions, but we were hoping that large producers would level the playing field.

This did not happen. We are providing surfers with the tools they expect to have to facilitate browsing and downloading according to the legal standards provided by the courts. Everything was removed in 24 hours like it should be.

Apology accepted, however, I'll point out some of that is still unmoderated user-submitted content. So, DMCA violations may exist on that site. However, we have not been informed of any issues.

We took over Talia's site in the last month and it's been selling like hotcakes. No idea how it was doing before we took it over though.

So I got curious after the claim of all this traffic you guys have. I looked up the sales we get referred from your site, pichunter. Sure you're a huge site, but you're not sending anywhere near the sales you should be if you truly have the traffic you suggest. You guys are huge, no question.. but in comparison.. FreeOnes has very similar traffic and they are always in our top 5 affiliates, where as you are not in the top 100. Odd wouldn't you say? I checked referring urls for sales and yup, Freeones and other affs are all over, where as PicHunter isn't. I thought that was odd. It's not the content, Freeones makes a boatload monthly from us.

You didn't @msg me trying to contact me, I checked. If I somehow missed it, you can point it out to me and I'll gladly apologize. Either way, you were specifically asked by Bryci and myself to email us if you wanted to clear it up. Did you? No. Instead you bring drama and post all over twitter and here rather than a simple email. Very professional I might add.

What does this do exactly? Affiliates weren't nailing sales using your site anyway so why do they care we're not there anymore?

I might be wrong, but you do understand without producers or girls, you are out a job, right? You need us more than we need you. In a perfect world we all get along but after reading how you handle things, we'd like to be removed, as we said.

Judging from the affiliates that have contacted me, thrilled we are not on your site now, and the others signing up for BellaCash, when you started to try and knock us down you ended up sending us more traffic.

You don't promote us, what happens? Nothing. Others still do and they get more sales because the content isn't as out there now. We're okay with this.

You're small time, and your content could be all over our site, and there really wouldn't be shit you could do to stop it. Cliphunter is a tube aggregator site though, you embed videos from tube sites like XVideos in Cliphunter's pages. Bryci's videos are embedded in Cliphunter pages?

I wasn't upset about it, I sent a DMCA to have them removed, same as every other site and not one site ever said anything other than, no worries, content removed.

That wasn't the normal DMCA we send out, that one was sent after a night of DMCA'ing and having several previous tube sites ignore emails. Seems the only way you get things done is to contact a host these days.
