Make a legal tube, they say you're just half assing it using sponsor content and won't gain any traction or get any significant traffic.

Make an illegal tube, and get blasted for having full length stolen content.

I was just pointing out that the videos aren't on his site. Whether or not the sites he scraped to get them licensed your vids, only you would know. As for the thumbnail, it might be hard to win that one as fair use would seem a pretty valid claim on a tiny thumb. This is especially true when bing is letting people preview the entire videos.

I dont host or have the actual movies on my site other than fhgs or movies given to me by owners.. I simply link to tubesite pages or use their embed feature.

If you see some content on the site of yours being linked to let me know. I would be more than happy in removing it from my site and helping you determine where it came from.

If you sell content to tubesites then really there is nothing more I can do on my end but remove the link to them.

Using a thumbnail from another tube is known as plugs to generate traffic. You send them traffic by using a thumbnail from their site and link it to the vid, they do the same back, Its the way tubes work.

Yes. However if he owns the video then he also owns the rights to the image and the thumb.
(Thus I am willing to work with him and willing to remove the thumb and even the link if he likes. Yes I dont really have to remove the link to the other tubesite but I will without issue if he requests it.
