So after talking to some people, I decided to out these guys.

The money was sent to Tim Youngs at http://www.ammediainc.com in error in Nov 08, and they promised repeatedly to send it back, and still.... nothing.

Seems odd that you would send that much money to a company - then realize it was a mistake. Sounds more like you paid them to do a job, then either they did it and you didn't like it and wanted the money back OR they simply never worked on the project OR last minute you changed your mind to use them and didn't realize that you couldn't get the money back. I never heard of them - but I still don't see how anyone can either mail a check (can be stopped) or wired it, which means that enough people were involved to have the right info in place. Just sounds odd.

either way - need more details as over the years on GFY I have learned, there are always two sides to any story.

I can totally see how it can happen, anyone who sends a lot of regular wires knows what a pain it is with the forms and templates... Mistakes happen.

I once visited my bank in person because there was a deposit on my statement for less than 1 dollar that I didnt make. I complained to them and they were just stunned that anyone would do such a thing as to bring it to their attention, let alone complain when they wouldnt remove it.

Ok I just read the other thread you have and here is your reason

"Unfortunately, It was really our fault. I had hired them to do a job for $4k about in Oct 08. They really didn't do the job, but whatever. Unfortunately I have had the experience before of paying up front for work that doesn't get done.

In any case, about a month later, I was wiring $25k to a processor in the EU. I was rushed as I was leaving that day for a show and I grabbed the wrong template. The money was sent instead to this design firm. I didn't realize it until several days later.

When we contacted them they promised to send the money back. They still haven't up to now.

I don't think that lawyers will be much help here... I need more underhanded and painful ways to get to these guys.

Anyone?

I do hope that you have a letter from the company stating that the money was indeed sent in error - that will hold up in court. If so then legally you can go after them on their own admission it was sent incorrectly. It's not the banks fault nor anyone elses.

Yet the letter you have from them (if I exists) clearly shows that they intend to pay it back and that it was a mistake. Check with a lawyer now - as far as outing them - sadly GFY I don't think will help too much in hurting their reputation as Im sure they have other sources of leads. Since so much time has lapsed I don't believe the bank will do anything - unless they are good and offer to investigate the matter. there is no way to "hurt" them also as then they can go after you legally if it is found out, and posting a thread is evidence now that you intend on harming them or slandering them somehow, and that won't help you out.

Lawyers letters and showing their letter to a judge then serve them is the only route now in hopes to get anything back - but sadly I fear this falls under the category of being your fault and they legally have no reason to give the money back (unless they have said they would in a letter to you).

Doesn't your bank ask you to go over the wire and sign it? I send a lot of wires and they always ask me to do this at each of my banks. I actually read it over too to make certain.

yeah my bank makes me jump up and down and do a back flip through a flaming hoop to send a wire.


but they said if i fillin some forms and some other jazz i can do it over fax...or automate it somewhat...so maybe that is what he did

i can usually send a wire with a phone call and the proper info needed

APP once accidentally sent me a pretty big wire, so it's possible. $25K is a lot of $$$, you should have contact both banks as well as local authorities, I'd even make a trip down there and talk to this guy in person.

I've been accidentally wired another client's funds (in addition to my own) at a processor before, to the tune of about $5k. I did the honest thing and got my bank to reverse the second wire.

You can sign an authorization of sorts that allows you to send wires over the phone with a password. At least my bank does.
