We have received strong support from many in the industry and beyond, who understand that Paul's fight is not just for himself, but for the all Americans. He is out on the front line and caught the flak, and by doing so, he is protecting us all. But words of encouragement are not enough.
In these difficult economic times, many of us are doing what we can simply to pay the bills and continue doing business. It's been twice as tough for us here as the government has seized our long time domain name, and forced us to establish a new home at MaxHardcoreTV.com.

good luck to max. everyone takes their own risks. i don't approve of his content, but i think he has a right to do it if its consensual and does not cause pain. if they wanted us all silenced, it would be done already. all the PPV on cable broadcast would be shuttered, all the adult video stores would be raided and locked up. they don't want all of us, just the ones who they can pick off easily using their bland, uninterpretable wishy washy laws. obscenity can never be defined under the guidelines that are set as of now. there is no written black and white. its all left to interpretation. therefore, efforts should be enacted to define obscenity and influence the laws to be clarified. otherwise everyone is a target of selective interpretation at any given time.

Do not think this was about 2257 either.

If you task our family values politicians to define exactly what they would ban, we would all go to jail IMO. the first amendment didnt stop the supreme court from creating & upholding the obscenity law. The vagueness of defining "patently offensive" & "prevailing community standards" makes it a tough road for Jonny Law to convict porn producers on obscenity. So mostly they get settlements from poor shop owners that cant defend themselves. We just had 8 years of an evangelical president & he couldn't do jack shit to stop the porn business. I like it vague...

I hear you but the politicians are not our friends. Congress votes overwelmingly for laws like COPA. The only thing that keeps us all out of jail has been the federal courts considering "non obscene" porn to be constitutionally protected speech.

Here is the big problem with Max's conviction.

You can argue that Max pushed the enveloped, fucked with the bull and got the horns. I personally don't like his content, but in that area I find most hardcore stuff kind of nasty and prefer the more softcore stuff. Call me old fashioned, but jerking off to a hot naked girl is fine by me. If it is hardcore I want at least the illusion that she is having a good time.

But this isn't about what I want to jerk off to.

Some of the things Max got convicted for were videos of his that were on the internet. Those videos were also simply trailers for other full length videos. Now the law says to find something obscene you have to take in the work as a whole, not just small pieces of it. That didn't happen here. They saw a very short trailer and used that to make their decision and toss him in jail.

COPA is gone, but some of the rulings of COPA linger. One of those rulings by the US Supreme Court is that you can use local standards when judging something that is on the internet. What this means is that if the convictions Max received for the movie trailers on his website are not overturned during his appeal any small conservative town in the nation can go to any MPG gallery you may post, watch your 30 second video clip and drag your ass into court, get a conviction and lock you away.

That is wrong.
The US Supreme Court was wrong with their ruling. Local community standards should not apply to the internet.
The court that handed Max convictions based on his movie trailers was wrong as well.

If those convictions are left to stand it could open a can of worms that could make things very ugly for this industry.

Love or hate Max. Love or hate his content, this is something everyone in this business should be paying close attention to.
