Ok, we will need your help and cooperation if we are to win this battle... I need each tube site owner to monitor there sites for illegal uploads....

We are going to build a program and database to help with this... We will be gathering information on all illegal uploaders....

Also... You guys are going to start requesting DMCA's from content owners... Yup, you will start to request them.. There is nothing in the law that says you can't... I am going to get the content producers together to set up a system to where you just have to push a button and you receive a DMCA via email, then you can legally take the video down right away with out waiting.... But you will keep the surfer active..


I know the above seems to much like work, but it is not, there is ways to make it easy and efficient... Once we get this all in place it will run smooth and we will get a handle on this BS going on...

Gather all the info you want on illegal uploaders, you can only do something about it in the U.S., try gathering that shit and going after private people in Canada, good f'in luck.

Do you have any idea what type of program/database it would take to archive even 5% of this industries content? Clearly not.

Any idea how you will manage that content, because I see what a VoD company has to go through and well... multi millions in just servers, I don't think you understand the scale of even 1% of this.

BTW, we already have some great companies that you can hire to do this for you, from what I gather they actually do a decent job at it. I don't remember the names of the service. They of course charge you because this wouldn't be possible to do on donations alone.

These illegal tube owners take "submissions" as anonymouse because 90% of the time it's them that are uploading it. Look at Redtube " submitted by Redtube A ". There not going to give you information on themselves.

2257 and tubes don't really mesh, and 95% of tube sites that are illegal are not USA based, so 2257 does not apply to them.

2ish years ago when I was going after tubes hardcore I dealt with some large lawyers and had extensive conversations with the FBI and they had zero interest in 2257 laws as it applied to sites like that.

They want to take down the big producers, nothing more then that.

The main tube sites, megarotic, redtube, and etc the large ones mainly do all of the uploads of stolen content them self. I know of a few that has in house staff that just does that as a full time job. Going after the end users is going to be a road to no where. We already looked into this ages ago with Airek and the anti piracy group, all roads lead to no where.

There are ways to fight it, but this is not the way.

Legals battles of this stature if you actually get it to court, and IF one day you win won't do much. Sure you "could" get a judgment against the pirate, but good luck collecting anything. The MAIN reason and I know this from fact in discussions with a lot of the top companies out there they don't go the legal route as it just would cost hundreds of thousands of dollars and have no significant return.

I also know for fact from one of the largest programs here during a discussion with them said in their research it would cost 350k just to get set up to get into court.. Then the real money comes into play. The cost of an actual legal team to fight the battle in court for months would far surpass that, and the end result would not really have an financial gain.

Let me add to this that most people in this industry the only thing they really care about is making money, how to make more, not how to push more out the door.

Two of the largest traffic brokers in Drinkinghard and Choker both sell tube traffic and deal with tube sites. And guess what, people are buying the crap out of it. And guess who those people are, the same programs who have tons of stolen content. There is no battle to be fought.

Plus, a lot of the main DVD studios in Los Angeles since DVD sales have slowed down are not blowing out their DVD's to anyone for any use. Lots of tube sites now purchase content in full length scenes to add to their sites. I know as I get hit up every 2-3 days from an owner after signing a NDA they break down what they do.

A lot of them are buying their own content and pushing in into the sites, makes it nearly impossible to police, when you look at a scene how do you know if they own the rights or not?

Plus, there are services out there like removeyourcontent.com that work really well and have a lot of clients who are very happy with the results. A lot easier to pay someone pennies to remove it and have a rather decent turnout from the money spent. Taking down half of it at a low cost over going the legal route makes a lot of sense.

I run http://www.wanktube.com ... the last thing I want is stolen content on my site! We limit uploads to certian sizes and the traffic really does produce sales for wm's. We actually try to keep it fairly wm friendly too unlike 99&#37; of tubes.

Though still get DCMA's for content idiots upload without permission, and while its possible to police most content its not possible to police everything. I am really interested in any solution which will keep stolen content off our site because its not only a pain in the ass to have to deal with, its creating more work for me! Focus on building your own legit tube traffic. Not much can be done legally about the others. Check out Nubiles Tube Script (Free), or Tevs or the new smart thumbs one. All setup for legit webmaster content.
