There is nothing in this article that says that "non-nude sites are illegal."

Each case has more involved than just your basic underage model site.

If there is real cp involved it has nothing to do with what is seriously becoming a problem and that is the underage niche.

Now if congress can enact some sort of law that will deal with this issue without violating civil rights then great.

But I seriously doubt this...even with the nude underage sites at this point in time as long as their is no gratuitous display of genitals or any sexual overtones then all the photographer has to claim is it's art and if he can prove that then he may win on appeal.

Is that the same guy that shoots for SC? I saw a link on their support board a while back that he got busted for CP.

A person under the age of 18 cannot sign a consent form without their parent's approval. That law is on the books. In order to have their photos taken and sold for profit on the internet, they must at least sign a model release form. Are their parents co-signing?

And on a subjective note, the article reads, "including some as young as 8 or 9 ? wearing revealing attire and striking suggestive poses." If you have to look at 8 year old girls to get off there's something wrong.. and a 12 year old girl in fishnets isn't art.

I said it before and I'll say it again, as in many walks of life, there is a terrible understanding of the law in the adult industry. Misconception and misunderstanding can lead to a lot of trouble.

Well that is part of the issue.
If not then they are in violation of laws other than running a "non-nude" site.

I've already answered this in my post. CP does not = nude.
You can photograph a fully clothed minor but if you focus and zoom in on the genitals you can be charged and convicted for producing cp, it's all about context.

If the guys were taking photographs that are judged to be gratuitous in nature they will get the punishment they deserve.

Now regarding art your example of a 12 year old in fishnets is a bit one sided.
We all know the implied sexual overtones of any female in fishnets.
Now if you have a completely nude girl even younger than 18 in an environment that does not scream sex, that might be considered art. We can judge on an individual basis that it is not art, but it will be up to the supreme court to judge on a constitutionality basis and they have already done so.

If these sites were taken down for legal reasons, then the billing companies, which charge for access to these sites, are accessories to the crimes as well as dealers in that they buy wholesale and sell retail.

Further.. thanks to a nephew of mine who I booted off of my system, I saw that the teen chat rooms on Yahoo, and probably other servers are loaded with 12 and 14 year old girls that are constantly flashing for the boys, who are probably lots of old sick fucks goin into the rooms posing as teen boys. It may be ok for my nephew in that he's 15, but not on my system.. no way.. no how..

Don't confuse the bad nonnude sites with the good nonnude sites. There are a few nonnude sites that only list galleries of sponsor content that shows obviously legal girls in bras and panties. These sites are good for webmasters since the less nudity you show in your gallery...the more likely the surfer is to click through to the actual site to see the nudity.

Ex. You make a free site full of Lightspeed galleries of Tawnee Stone and XXX Raimi in bra and panty shots. The conversions on this traffic would be great.

I've been thinking of making a nonnude site like this for a while now. Using Lightspeed galleries and the content from a couple other sponsors.

^ I've been doing this for a long time and it works well even though I don't get a lot of traffic. I used to have snapshots of girls 16-18 on my site (I started my non-nude "career" when I was 17), and I even promoted Jim Grady's sites for awhile (don't tell the FBI) but in the end I could see why most people equate non-nude sites with child porn, and I finally changed all my sites to 18+ content and adult sponsors.

I think what people are complaining about are sites like Teenplanet.org that continue to use underage content, while simply switching sponsors from True Teen Babes/True Teen Cams to Tawnee Stone, etc.

However, from the sounds of that article, all these guys were actual sickos who had real child porn on their hard-drives, even if they weren't selling it on their sites.
