The free content downloads on dieselcash.com are TEMPORARY disabled, while we are rechecking the licenses of each end every content provider. We are NOT planning to disable it totally since as far as I see by now, distribution of the limited number of images for TGP posting does NOT violates the terms and condition of most of the content providers. Therefore, the content downloads would be available again within a couple of days, once our attorney finishes checking the licenses. Again, there was NO license problem with most of the offered content, we just want to be 100% sure about each and every image.
Regarding the claim of AaronM, according to his license the ONLY problem we have discovered, is that his license allows using up to 10 images per TGP set, while we were offering 15.
We are going to correct this issue, as well, as the number if images offered by other content providers according to license of each and every one of them as it will be advised by our attorney and the content downloads would be back online approximately this Monday.

AaronM, if you were contacting us directly, I believe we were able to resolve this in the most profitable way for both of us, however, since you have decided to go public, before reading your own license and contacting us directly this is what gonna happen:

Of course we will reduce the promo image sets down to 10 images per set, since we have no intention to violate the terms and condition of anyone we work with. However, since we prefer to purchase the adult content from the ADULT content providers ONLY, we have no choice, but to stop purchasing the content from you, despite it?s quality.

Correct me if Im wrong but when it says you can use a certain amount of pictures for tgp purposes I would assume it is on the domains you own or specify on the licence. You cant just give out the content to all your webmasters.

I will say that the guys contacted me after I had posted in this thread and before I had a chance to email them, and have assured me the downloads are coming down. Thanks for getting onto it quickly even before I contacted you.

However regarding this statement in the post above

I am not sure of any content provider that allows you to give sets away to webmasters without buying a specific license to do so. It basically makes content totally worthless if you are giving it away to 1000's of affiliates for free so no one is going to let you do that for a set that you are only paying $30 for that probably cost several hundred to produce.


I have made the guys at dieselcash aware that if we do come across galleries with our content in it that has been provided by dieselcash we will be issuing DMCA take down notices so if you are an affiliate and using the free downloadable content (the hosted galleries are fine) I would check with the guys at Dieselcash to see if you are affected.

You need to have a special license or or own exlusive rights to the content you give away for free to your affiliates. I guess there is no need to say that the fee for such license (or exclusive rights) is MUCH higher...

It appears that YOU are the one who didn't read the agreement..
to wit:

Aaron Matthews Productions, LLC retains titles and ownership of the Licensed Product, and gives up no legal rights as part of this Agreement. Licensee agrees not to sell or distribute the images via any physical method (such as diskette, CD-ROM, paper printing, or any other technology not specifically named in this document) without Aaron Matthews Productions, LLC prior written consent. ........................

2. Acceptable Uses of Licensed Product.
......... The Licensed Product may not be placed on a website with the intent to resell or allow the content's use to other webmasters. .....................

Good move Diz, AeronM is an asshole anyway. He likes to shoot is mouth for nothing, I hope you buy you're content from somebody else!! Aeron their is other ways to resolve issues then going public, I was thinking of buying content from you in the past but seing how a jerk you were, I went somewhere else!

I purchase from Aaron M and im verry happy with his content. As a player you know the rules and Dieselcash has broken them bigtime. No matter how it happend, Iy you are the pro's you claim to be you should first offer Aaron M an apology and second pay him at least some bling bling for making his content worthless with your actions.

Why would someone need an attorney to interpret that? Diz is either not to bright or simply thought he could get away with cheating.

Don't worry, he's got his team of legal experts pouring over it. Maybe he just assumed paying 30 bucks for a set meant they were exclusive. 30 bucks in his country is probably a fortune.

Gary, what you mentioned about him thinking that he could give my content away for TGP usage is exactly what happened.

Diz, The thread started out asking for info on you company. People asked questions and I was honest with them. If you have a problem with that then perhaps you should rethink your business practices.

Scootermuze, Thank you for posting that, I will however state that 2 words were added to my license agreement in section 2 and that this client may not have the current agreement, however, section 1, 2 , and 3 on even the old agreements did not allow for this sort of thing.

Those who wish to attack me can do so as much as they like. It is clear that dieselcash was using other providers content against the licenses as well. Thank you Jason.

Hey everybody, let's not hang the guy just yet. At least he has taken down the images and is making an attempt to rectify the situation. Yeah, I am pissed but let's wait and see how he handles it all.

Yes absolutely, we have purchased all of Aarons content as well, your actions have diluted the product a great deal! Instead of acting High and mighty, and not buying his product in the future,(like he would sell it to you) I think an apology is in order from you

First of all the problems with all the content providers, who took an advantage of contacting us are resolved. Of course there was no intention to cheat anyone, or to save money, since we believe, that the last thing, that you can save money on is the content, and we are spending dozens of thousands of $$$ every month on shooting and purchasing the content from a lot of different providers, in attempt to keep the subscribers. However, the content providers must understand one simple things: The last thing the content provider should save money on, is the attorney.

I?ve checked today dozens of content licenses, and it appears, that most of them are written in EXACTLY the same words and sometimes even with the same typos J

Do you guys just copy the text of your licenses from other providers or what ?

Let me ask you something:

Take a look at those lines:

How the hell, should we understand those lines, that I have just copied and pasted from the license of one of the content providers.
Most of you have those lines in your license text. Maybe it is not your intension, and you have meant something else, while saying this. But, you must also understand, that if you want your customers to keep your terms, those terms may not be ambiguous.



Anyway, we have no intention to argue with anyone, and we will remove the content if any of your will request it from us, ALTHOUGH your terms are ambiguous, but probably, if your terms were clear from the beginning, we could prevent all this situation, and save your nerves and our money, by purchasing the content from the provider, who?s license fits our needs or were changing the contract with you.



Please understand, we had no intention to cheat on anyone. It is just misunderstanding of your terms, that IMHO are too ambiguous.



So if anyone still have any question to us or would like to claim anything, is always welcome to contact us directly, and I don?t believe there is anyone here, who had ever attempted to contact us and was ignored.

Says as long as its hosted on the purchasers URL it should be okay, so it says above, to my knowledge.
