http://www.imagecash.net/ - I was trying to pull the guys account #, but he keeps everything in a frame so you can't see his account.

I really think you should cancel his account...he is ripping a lot of honest companies off with stolen content and making money on it.

The guy is German, so it would be hard to get him in court, but cutting off his funding is a sure-fire way to put him out of biz.

I just talked with 3 guys from other programs with exclusive content. Everybody who looked found something.

AFF should ban him.

Yup, that site looks 100% stolen content. Also looks like they are cutting watermarks off some images because they think if there is no watermark it is legal to steal the content. :upsidedow

If you go through the forums, there is a post that says if there is no watermark on the image, it is not considered stolen or a copyright violation.

I presume it would be hard to monitor them all.

Maybe sending an email to them would help in this case.

If after then nothing happens, that would be the time to have a rant =)

Actually I stand corrected. I saw one pic of Oral Amber with the watermarked trimmed, some CindySinX pics with the watermark removed, and some other girls who's names I can't place. There's probably more but it only took me a few minutes to find those ones. :) But you're right, almost all have watermarks.

Well as you guys say "AFF has a lot of sponsers, how can they keep track of every one of them", Imagecash.net apparently has roughly 170000 galleries (galleries, keep in mind not individual pics)....how without looking at each pic are they supposed to keep track of copyrights? (yeah yeah i know its their job)

his whois is info is apparently wrong.
his address is german, but his country code says NL for netherlands.

also his site is illegal in germany. as soon as the feds notice it he'll go straight to court.

Considering the answer given by Lars in the thread regarding Fusker, I think the answer is this:

Send an email to legal @ whatever there corporate domain is (finderinc.com?) with details of your claim. Legal will look at it.

What he is really saying is that unless there is caselaw or a valid DMCA complaint from the content owner, it is unlikely anything will happen.

AFF companies have made their choice how they will handle these issues, nobody should be surprised at the end result.

I seriously doubt it's Image Cash removing the watermarks. It's the users. Or that's how they found them on another site and they just put them on this site as is. My reasoning for that is because 50% have the watermarks, 50% don't. Of course, maybe they just haven't gotten around to editting the ones with watermarks. *shrug*

i think, now dont quote me on this, you can find a sponsor liable if they are in fact allowing an affiliate to promote them via shaddy methods, or being promoted ligitamatley on a page incorporating shady methods. When I used to run sufer forums back in 1999, when you would hotlink a sponsor, the smart sponsor would go after the other sponsors on the page as well.
I dont know how exact this is, maybe i was just scared into remove the link hottens, but in anycase AFF should do the right thing.
Whats sad is you cant just show your attorney this page and say "act." They dont know a thing about the technical side of the net and if this guy is cloaking, redirecting etc, you just went down a 300 dollar an hour goose chase and ending up having to hand your attorney the wrong doings on a silver platter, for him.
