This is the first time I have had to call someone out on GFY like this but I am upset! Now I understand that having a million pictures all over the net is just asking for people to steal them and use them for there own. Now when I contacted the above compnay they e-mailed me back telling me they had the licence to use my photos and that I work for them. If that isn't a bunch of made up shit I don't know what is. I know this is a buch of shit cause I own the rights to all my photo's and never would of give them to anyone. I have no clue what they are talking about I had never even heard of there company before this.

Here is the e-mail they sent me back after I contacted them as well as the screen shot from there site stealing my pictures!

Melissa the best you can do is send them and their hosting company a Cease and Desist legal notice. They're in Germany which makes it pointless to do much more than that - if their hosting company is in the U.S. i'm sure they'll get the thieves to take your pics down - if not, just forget about it unfortunately.

Met them in FL and they seemed alright, well they probably are thinking that they are outside of the US and they can get away with it.

Thats cool man. We are posting this message for people like you. Now you know the real side of them, and know not to do business with them. They are copyright thieves, and they don't care. If you do business with them and they had the opportunity to steal to profit for themselves, they would take it. This response just makes it seem obvious they knowingly steal content. To be honest, we are not real difficult people, they could've apologized, said it was a misunderstanding, and removed it completely. That would have been the last they heard about it. But they chose to lie and claim Melissa works for them, which couldn't be more far from the truth than possible. I would love to know what "agreement" they are talking about.

It's obvious from there response they can't even talk english either, and they sound russian.

It IS possible that they bought content from someone who didn't have the right to SELL it, so they believe they do in fact own the content.

Did you do cam shows on there network?
Do you know if there cam show model contract has a clause that allows them to use certain pictures for promotional material?
If it does it may be possible that some less attractive blonde cam girl swiped your pics to use in her profile ;)

No way! I run my shows through my own server I have never used a compnay for them in any way, shape or form. Melissa

possible - yes. likely - no. If it is true, this would be the first I have ever heard of it (that is someone selling our photos). The bottom line is there are tons of pics of melissa chatting on her laptop, after all we do 2 live shows every week. Very easy for them to take some of those pics and spit it out in an ad for their own site. Their response was very terse and short, they could've easily attached an agreement or a license instead of merely saying "we have a license." After all, we did send them a legitimate legal letter. Add in the fact of broken english and a Russian last name by the party signing off on the letter.. I highly doubt they have any license, authorize or non-authorized.

I also wonder about all their other girls in the promos, on the tours, and inside their members areas. Something small like this speaks volumes.

melissa, this happens to me all the time. if the site isn't US-based, or isn't hosted in the US it seems that you're s.o.l. - most of the time i send an email and point out that my photos have been stolen for use on their website and that they're not authorised to use them and do they have legal information about the model in them to prove that she's over 18 ("she" being me) to try to intimidate them into removing the pics. if they're in the US i pretty much always hear back and the pics are taken down. if they're internationally based, i'd say 1/2 the time i hear back, the other 1/2 i don't. it's so frustrating! :2 cents:

Could you not find someone in a foreign country to make the call for you, as your representative? I just find it hard to believe that they don't have their own copyright laws. I can see them ignoring an American citizen, but if someone from over there contacts them OR their hosting company with the threat of legal action from within their own country, I'd like to think some action would be taken.

Scenarios like this are why I'm not a model.

Yeah okay, it's not the ONLY reason, but still.

Melissa I'm thinking if you e-mailed them from you domain name then maybe they would take you a little more seriously. For all they know...its just some random person e-mailing them from a hotmail account.

Yea it does get old! I find like 20 of these a week but most are not company's making money off me they are just people trying to pretend to be me on chat sites. Both are frustrating but to get an e-mail back from them saying that I work for them now this is another thing. I would of never posted this otherwise but that took it to a new level. I keep hearing all of this "the server's in another country, good luck" crap. Er, this isn't Java or Zaire we're talking about here! It's freaking Germany. It's the E.U. They have as strong or even stronger rules about this nonsense than the U.S. (You saw what the EU did to Microsoft!!)

So go after them same way you would here. Write the host and have them shut down. Wouldn't hurt if you get a translator and send the email in both English and in German.

This is one pic of a "no name" model not Microsoft. It's basically not worth it to go after them. It will cost more then her fuckin pic is worth. She probably won't be modeling in a few months anyway.

Doesn't sound like the situation at all if they are claiming they own her rights because she works for them. Sounds like a confused support person who doesn't know english well and is just trying to brush her off a standard reply.
