Excuse the newb question but I recently started a thread asking if hosting providers can be held liable under 2257 for the content hosted on their servers.Most answers said no, so why would a non-US webmaster move to non-US servers?

Simple the HOST is immune. Doesn't mean the DOJ can't tell the US host to shut the site down. If you ran a CP site you host is immune from that too doesn't mean the government can't tell them to shut your CP site down. Why should a non-US webmaster risk getting his site shut down when it's just simpler to move his hosting to non-US hosting?

What about the webmaster? Is hosting on a US server somehow makes him at risk for prosecution..?

My server is practically in the building next to the Amsterdam internet exchange (ams-ix) lol. I've been hosting my 125k uniques 400k views a day website in Holland with them for 6 years straight with pretty much no downtime. They are not the cheapest on the market but certainly the best in webmaster support and understanding wemaster hosting needs.

Physical location of server hdd is the deciding factor in this issue.

If you are a US citizen living in the US, it doesn't matter where you host, you are required by the law of the land where you live to comply with 2257, however, if you are a non US citizen, living outside of the US, and your hosting servers hdd are outside of the US, then you are immune to the regulations.

I don't know what to do... When it become necessary I'll transfer it definitely....
