No link but on the seattle news they had this story about a guy who makes 100k a year working from home. Apparently he noticed a clause that allows for damages for "pain and suffering" if you are called by telemarketers if your on the "no call" list.

He basically sits by the phone all day and waits for telemarketers to call him. He records every call , then marches off the the courthouse , files papers against the offending company and a recording of the phone call and sends it to the offender. Theres like a $5,000 limit per call so the companies usually just settle out of court and send him 2 or 3 thousand dollars.

They were playing this one telemarketer back and he was basically mocking the guy saying " i can call you whenever i like blah blah" , like telemarketers do when your upset and the guys like " he is gonna pay for that " :) classic shit..

Fine for one call, but after awhile it's a pain in the ass. Now if that phone call wakes you up cause your a webmaster and have late hours....

Over here we have what's called a "Do Not Call" list. Telemarketing has gotten almost as bad as spam. If you're on the "Do Not Call" list and they call anyway, well, you can sit in Seattle, record calls and make $100k a year.

A couple of years ago I also saw where some lady took Sears to court and won a bunch of money because their telemarketers kept calling and asking her if she wanted to buy that extended warranty, insurance crap on some stuff she had bought. It went on for months until she finally sued them. They wouldn't settle and thought they'd beat her in court with their fancy legal team. They got their ass handed to them and the judge got all over them, too.

The best part was that a day or two after she won the case, the stupid fuckers called her again and did the same thing. :1orglaugh

Yeah, but it gets old when its happening 10 times a day, fuckers calling you during dinner, or early in the morning and waking you up. Its your home and you DO have the right to privacy in it.

I try to be nice about it, and tell them I am not interested right from the start. When the persist, I am polite and explain to them that I understand they have a job to do and if they don't mind I am going to sit the phone down and they are free to read their script or say their pitch and when they are done if they would be kind enough to hang up so my phone can alert me that it is off the hook I would appreciate it.

I play a game I saw in a movie once (I forget the name of the movie).

They ask if so and so is in and I say one moment. Set the phone down and continue doing whatever it was I was doing. Its fun to see how long each company will wait for someone to come back.

Only 100k/year? That's only the equivalent of 20 penalties at the maximum fine. I should partner with this guy and hand off all my telemarketing calls :)

Heh :1orglaugh Well actually he said some of the companies just switch names so quick he cant catch them and it isnt worth the court filing fee. But yes i get a ton more than that.
