Prostitution vs. Shooting a porno

I always wondered what the difference was between paying a prostitute for sex and filming a girl you are having sex with (legally), like those point of view movies do.

I am in no way comparing porn stars, or porn girls to prostitutes, but what makes a girl having sex in front of a camera legal if she signs a contract and not a prostitute? Is it bearly the fact that she is signing a contract?

Could a prostitute set up a home business where she legally films herself having sex with regular joes while never publishing the content?

Good question.

maja 05-05-2005 02:29 PM

the difference is paying taxes or not paying taxes. I'm sure if the gov't can have a way of tracking & controlling how many clients, money, etc a prostitute or escort brings in then it would be legal.

interesting point. So according to you, if a prostitute had her clients sign release forms and provide ID while she declared income, it would be legal for her to be a prostitute?

eroswebmaster 05-05-2005 02:32 PM

I highly doubt "johns" would want some prostitute filming them having sex along with making copies of 2 id's etc to make it all seem legit.

I agree, but I am sure many desperate lonely guys would rather fuck a girl legally than risk getting caught by the cops. No?

nobody would know.

Same thing man, trading sex for money

andrej_NDC 05-05-2005 02:40 PM

porn stars are prostitutes, they just think otherwise

tranza 05-05-2005 02:44 PM

I agree with Huggles and andrej_NDC on this one...

BigRod 05-05-2005 02:47 PM

I have to agree money for sex is what it is!

Tempest 05-05-2005 02:50 PM

The question is.. what is the legal difference..

Not what is the opinion of all the sheep...

but what would one expect from this place..

psili 05-05-2005 02:50 PM

Somebody else said this already in the same thread a while ago.

The difference is that porno is protected under the first admendment as "art" - or something to that effect.

Bomber8888 05-05-2005 02:51 PM

Prostitution is prostitution .. sex for money!

Rorschach 05-05-2005 02:51 PM

why not compare pornstars to prostitutes? they both suck dick and take it in the ass for money... and many pornstars whore themselves out on the side as well.

billywatson 05-05-2005 02:55 PM

The correct answer, gang, is Miller vs. The State of California, and I think it was 1972. Also, I'd like to add that it's really pandering we're talking about here, not prostitution...unless you're shooting a POV.

Miller argued, basically, that since there was a plot to Deep Throat, it was, in a way, legitmate art...sex just happened to be in it. The judge agreed, and, in fact, this is the only place in the country this thing has been tested...that's part of the reason Porn Valley became Porn Valley.

Pandering is paying people to have sex in front of you, whether or not there's a camera in the room. In my state it's a Class 6 felony...SO, the moral of the story is...make your porn have a "plot" no matter how silly it may be!

BigRod 05-05-2005 02:56 PM

In Canada the ONLY difference is, if you want to film it you have to have ID!

thumbsdepot 05-05-2005 03:02 PM

Here is the California law about prostitution, some states may be different.

CALIFORNIA CODES
PENAL CODE
SECTION 653.20-653.28
653.20. For purposes of this chapter, the following definitions
apply:
(a) "Commit prostitution" means to engage in sexual conduct for
money or other consideration, but does not include sexual conduct
engaged in as a part of any stage performance, play, or other
entertainment open to the public.
-------------------------------------------------------

My understanding is if you pay someone to have sex with you and film it, then distribute it then that would be legal. But if you pay someone for sex and don't film it or let others watch that that would be illegal.

Contact your lawyer to make sure.

Huggles 05-05-2005 03:04 PM

Before anyone bitches, nobody said there was anything wrong with prostitution.

:)

Like I have said before though, nobody wants their mom or daughter to do porno though. Other people's moms and daughters? sure! :)

azguy 05-05-2005 03:10 PM

Then some chick needs to open up a website calling guys to come down and fuck her (and even get paid a little) on camera for it to be posted online.

GoldenPalace.com would be her first client :1orglaugh :1orglaugh :1orglaugh :1orglaugh

Dirty Dane 05-05-2005 03:21 PM

So, if it is the same, what is the difference between a pimp and a.. eh webpimp? If you sort out the legal issues, I mean. :pimp

wtfent 05-05-2005 03:27 PM

I think prostitutes do more drugs.

there are cheap prostitutes who will fuck anyone and also cheap actors who will fuck anyone...the same chance of taking drugs
but also there are damn expensive gorgeous looking prostitutes who wont fuck anyone and also expensive porn-stars who wont fuck anyone, they mostly live a normal life
and of course, something between :)

the difference i see is that there is content being produced in one instance and none in the other.
other than that, there's not much difference.
i can totally see how porn stars could easily escort to make extra bank.

they do, and it's called "privates".

In The Netherlands prostitutes are legal and they indeed do declare taxes.

Hmmm ... I never thought that going to a Hustler Set with professional Photographers and Videographers was like going to some abandoned Motel 6 and meeting some random guy who may have the fate of my last breath in my life. In PORN who is the "Jhon"? Cause im not fucking the "Jhon" Im fucking another hired/Paid talent to make a MOVIE. YOU GET PAID FOR ALL work in different walks of life. Why does everyone take sex so seriously!

SmokeyTheBear 05-06-2005 01:42 AM

There is a company in vancouver canada that basically works the way you suggested except one step better its free..

They basically supply a "fantasy" .a man can simply call them up with a fantasy , they supply the woman/man/? , and you supply yourself. You get to fulfill your fantasy and they pay for the woman/man/etc and get to film it..
