German Censorship Agency Letter Received Re. Paysite tour
Has anyone else recieved on of these from BPjM ?
Basically it says that the spreading of pornographic content via the internet is a criminal offence under German jurisdiction. Site tours are included unless an approved age verification system that can guarantee minors cannot access any content including advertising context are used. Continuing violations will be punished by law under German jurisdiction and you have 14 days to defend against the charges (or remove the website or place an avs infront of the paysite tour). (the letter came registered) I am not in Germany by the way and am hosted in the US. |

Its also available online on their website. http://www.bundespruefstelle.de/Texte/General.htm They also sent two documents German which seem to outline the offences. It also says something about sites that are linking to your site are also offending by way of advertising indecent materials. |
If I'd be you i'd throw it away.
If you ever plan on traveling to germany I would redirect all german traffic to an AVS page.... |

Maybe Germany should think back to what happened last time they tried to force their ideals on the world. They're apparently aware of the failure of national Socialism, they even mention it on their own site:
2. In the area of the glorification of Nazi ideology and racial hatred Propagation of Nazi ideology so as to be liable to have an undesirable influence on the moral development of young people is present, - if the ideas of National Socialism, its racial teachings, its authoritarian dictator principle, its national indoctrination programme, its readiness to accept war and its conduct of warfare is canvassed; - if the killing of millions of people, in particular the systematic extermination of Jewish people in the so-called Third Reich is denied; - if the Nazi regime is intended to be enhanced in status and rehabilitated through falsified or incomplete information, in particular, if Adolf Hitler and his fellow Party members are portrayed as models (or tragic heroes). |
and if you do go to Germany, dont mention WW2
|
WarChild it doesn't have anything to do with facism just with fanatic youth protectors that you'll find everywhere in the world.
And because those people don't know shit about the internet they try to enforce it worldwide and won't even write letters in english.Just a waste of taxpayers money... |

Don't worry about it and just frame it.

For those posting Nazi references it might be interesting to know that anything to do with Nazism (whether talk, books, historic artifacts, etc) is pretty much illegal in Germany too. Seemsmore appropriate to say Stalin left his mark when he took the East.

I'll be the dissenter here and say don't just dismiss it. Talk to an attorney. The fact you're transmitting your website to their country probably gives them some legal right.
I have this on all my warning pages ..... "I am an adult over the age of 21 and the viewing, reading, and/or downloading of images from this site do not violate the community standards of my locality, city, town, county, state, province, country or other community to which I belong " So, someone in Germany reads that and it DOES violate the community standards of their country ....... legally, can Germany go after someone from another country? I know Germany has extremely strict laws about what you can send via the mail. You can't send any material that is sexual, even r-rated, unless you send it to a registered business. |

i don't think that anyone from Germany will go after someone from another country. If you are not a german, not hosting in Germany and not using .de domains nothing will happen. No one can tell you not to make websites in german language. and such disclaimer you are using are not worth the webspace - they're bullshit. are you a german and living in Germany? than you have to follow the law and use an AVS (which is btw the biggest nonsense ever). If you are not living in Germany fuck the german laws. :2 cents: |
