If they can't get you in either one of those, they'll go after you in state civil court. Double jeopardy means that once a criminal case is dropped or a person is acquitted they can't be charged again criminally, it is entirely separate from civil courts. Many, many people file civil suits on someone whether or not they were charged criminally and regardless of whether they were found guilty or innocent in any criminal proceedings.

I agree to a point, but the rape shield laws are very biased and therefore, dangerous.

There was talk yesterday of bringing in another woman who would testify that Kobe was agressive towards her.

Fine, I have NO problem with that IF it shows a pattern and is relevant.

But the rape shield laws prevented (prior to this case) the defense from bringing up things that may have shows that SHE was someone with a history of lying or serious mental problems. Her past mental problems MAY BE relevant as well.

There needs to be a balance and this case may have helped.

Unfortunately, you're right in that alot of REAL rape victims (I'm not saying she WASN'T a real rape victim, I haven't heard any real evidence), won't come forward as easily as before.

Also, in rape cases, the laws are usually so slanted towards the prosecution that it's more a case of the defendent having to prove HIS innocence. That's not the way the legal system is supposed to work.

I guess the presure is too much :p

Now there is a possibility of a case being dismissed "without prejudice". If that happens then there is the possibiliy of reopening criminal charges if compelling new evidence is uncovered. It's an uphill battle for a prosecutor to get that and if they do uncover "compelling new evidence" they will have to convince a judge that it is strong enough to reopen the case, again, very uphill.

well... lets just hope that at the end of this endless case JUSTICE WILL PREVAIL...

you have to understand something from an athletes point of view - there are many women out there who definately cry foul on this - it is well documented. I remember being recruited out of highschool for football and the coaches warning you not to sleep around - because of girls like this. There has been cases of girls waiting unitl an athlete gets drafted and then crying rape. It's ridiculous. I have friend who play professional football now - and I have been in their locker rooms after a game - girls are just waiting outside. Why would you need to rape a girl when there are groupies waiting for you.
