jail for spamming is stupid.
 
and no i have never sent a single spam, but locking someone up for sending out emails is just stupid. letting them pay money will do, no need for jail.

I'd be OK with jail for a 2nd conviction. First conviction hit 'em with something like fines based on 2X provable income from the spamming. Make it easy for investigators to get payout records from sponsors if they have proof of spamming.

In certain circumstances I think jailing for spam is neccessary.

If the average spammer wastes 3 seconds on average for 1 person, and they spam 10 million people, then that's about 8333 total hours they waste of human time.

Multiply that by a minum wage of 5.25 per hour, and that's $43750 wasted if you save an average our is worth the minimun wage.

$43750 in time wasted for 10,000,000 spam emails (based on these numbers)

I think it's worthy of jail time. :2 cents:

Yep, zip the mails with full headers open and forward the ones that don't adhere to the new law to the State and Fed officials.

We save junk mail and invest about 10 bucks a year and mail big envelopes full of it to the people that sent the most each year. lol

Doesn't do any good, but it has to add some humor to SOMEones day out there. ;-)

The problem is they've been fined in the past and its proven not to be a strong enough deterrent to prevent them from continuing. At some point you have to raise the punishment to a point where they will think twice about their actions. Granted their will always be those who are going to try and get away with something. However, I guarantee you that when some of these cases send spammers to jail and its out in the press, there are some spammers who will cease what they are doing.

The "jail" issue is the same thing as most computer crimes. A lot of hacking related offences can result in the same kind of punishments as more "serious" physical crimes.

However, the benefits/damages of hacking and spamming are so high that the only effective way to threaten the people who take part in these activities is to make the penalties extremely severe.

Yeah true but then a few guys will have to do quite some time only to be an example. Same thing with filesharing right now, ltos of attention from the media and stuff, but everyone's still doing it.

I disagree .... our world is becomming more and more dependant on the Internet. People, organizations and government rely on the Internet for communication. Bandwidth is not cheap, and it is necessary.

When you start flooding pipes and routers with junk you are hurting a lot of people and costing them a lot of money.

First time offenders should be fined, but repeat offenders definitely should see jail time.

I go thru 140 spam every morning and 95% you cant get off their list. The difference between spam and junk mail is one they spend money to send it and secondly I can find the company that sent it very easily. Also graphic spam has to stop, people have to wake up and realize its going to seriously hurt our industry. Its adding lots of wood to the rights fire.

Do you go to jail for fraud or stealing? Do I like paying for the bandwidth used from all of the unwanted/spam messages and the harddrive/storage space required for those?

I agree... I waste so much time every fucking day deleting and reporting spam.

My time is money, and their stupid fucking scrambled word emails with retarded titles and mixed up letters equate to internet littering and garbage.

Not to mention the porn spam that winds up in underage kids mail boxes.

Imagine out in the real world, if people distributed flyers advertising porn and penis pills all over car windshields in a mall parking lot.

Don't you think the authorities would come after them if they could? Yes, and they would get in trouble.
